Section 135.61, subsection 18, paragraph m, 1 2 subparagraph (4), Code 2015, is amended to read as follows: 1 3 (4) Radiation therapy service applying ionizing radiation 1 4 for the treatment of malignant disease using megavoltage 1 5 external beam equipment with a value in excess of five million 1 6 dollars. 1 7 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 1 8 immediate importance, takes effect upon enactment. 1 9 Sec. 3. RETROACTIVE APPLICABILITY. This Act applies 1 10 retroactively to July 1, 2014. 1 11 Sec. 4. APPLICABILITY. This Act applies to certificate 1 12 of need applications submitted on or after July 1, 2014, for 1 13 radiation therapy service applying ionizing radiation for the 1 14 treatment of malignant disease using megavoltage external beam 1 15 equipment, and a party who is an affected person with respect 1 16 to the application may seek a rehearing on the application 1 17 pursuant to section 135.70. 1 18 EXPLANATION 1 19 The inclusion of this explanation does not constitute agreement with 1 20 the explanation's substance by the members of the general assembly. 1 21 Currently, a certificate of need is required for all 1 22 radiation therapy service applying ionizing radiation for the 1 23 treatment of malignant disease using megavoltage external beam 1 24 equipment. Under the bill, a certificate of need would only 1 25 be required for such radiation therapy service with a value in 1 26 excess of $5 million. The bill takes effect upon enactment, 1 27 is retroactively applicable to July 1, 2014, and is applicable 1 28 to certificate of need applications for radiation therapy 1 29 services submitted on or after July 1, 2014, and a party who is 1 30 an affected person with respect to the application may seek a 1 31 rehearing on the application.
