S.F. 293 Section 1. Section 68B.3, Code 2013, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 2A. This section does not apply to sales 3 of services by a person subject to the requirements of this 4 section to state executive branch agencies or subunits of 5 departments or independent agencies as defined in section 7E.4 6 that are not the subunit of the department or independent 7 agency in which the person serves or is employed or are not 8 a subunit of a department or independent agency with which 9 the person has substantial and regular contact as part of the 10 person’s duties. 11 EXPLANATION 12 This bill relates to the sale of services by an official, 13 a state employee, a member of the general assembly, or a 14 legislative employee. 15 Currently, a state executive branch official or member of a 16 board or commission, state executive branch employee, member 17 of the general assembly, or permanent, full-time legislative 18 employee is prohibited from selling goods or services having 19 a value in excess of $2,000 to any state agency unless the 20 sale is made pursuant to an award or contract let after 21 public notice and competitive bidding. The bill provides an 22 exception to the prohibition for the selling of services to 23 state executive branch agencies or subunits of departments or 24 independent agencies that are not the subunit of the department 25 or independent agency in which the person serves or is employed 26 or are not a subunit of a department or independent agency with 27 which the person has substantial and regular contact as part 28 of the person’s duties. 29 -1- LSB 1870SV (1) 85 tm/rj 1/ 1
