  2    education instructional endorsements to a practitioner
  3    license issued by the board of educational examiners.

  1  1    Section 1.  Section 272.9, Code 2015, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  3.  a.  The instructional strategist I,
  1  4 instructional strategist II, or either of the kindergarten
  1  5 through grade twelve mildly disabled endorsements issued under
  1  6 282 IAC 14.2(2=7), to practitioners on or before July 1, 2017,
  1  7 shall continue in force after July 1, 2017, and a practitioner
  1  8 who continues to meet the conditions for practitioner licensure
  1  9 under this chapter shall be permitted to perform the same
  1 10 duties and functions as the practitioner was entitled to
  1 11 perform with the endorsement issued under 282 IAC 14.2(2=7),
  1 12 effective on July 1, 2017.
  1 13    b.  If a practitioner who holds an endorsement described
  1 14 in paragraph "a" meets the requirements for a kindergarten
  1 15 through grade twelve endorsement or for a special education
  1 16 specializations endorsement under the rules effective on or
  1 17 after July 1, 2019, the practitioner shall be permitted to
  1 18 convert the endorsement described in paragraph "a" to the new
  1 19 endorsement without payment of a fee.
  1 20                           EXPLANATION
  1 21 The inclusion of this explanation does not constitute agreement with
  1 22 the explanation's substance by the members of the general assembly.
  1 23    This bill provides for the continuation in force after July
  1 24 1, 2017, of certain special education endorsements issued by
  1 25 the board of educational examiners to practitioners on or
  1 26 before July 1, 2017.
  1 27    The board has submitted to the administrative rules review
  1 28 committee notice of intended action to eliminate four types of
  1 29 special education endorsements on July 1, 2019: instructional
  1 30 strategist I, instructional strategist II (including behavior
  1 31 disorders and learning disabilities, intellectual disabilities,
  1 32 and physical disabilities), K=8 mildly disabled, and 5=12
  1 33 mildly disabled. In their place, under the notice of intended
  1 34 action, are the K=12 special education endorsement and the
  1 35 special education specializations endorsement.
  2  1 The bill provides that a practitioner who holds such
  2  2 an endorsement and continues to meet the conditions for a
  2  3 practitioner licensure shall be permitted to perform the same
  2  4 duties and functions after July 1, 2017, as the practitioner
  2  5 was entitled to perform with the endorsement held on July 1,
  2  6 2017. A practitioner who applies for an endorsement after July
  2  7 1, 2017, may apply for any of the six endorsements available on
  2  8 that date, but the validity of the expiring endorsements would
  2  9 not extend beyond June 30, 2019.
  2 10    The bill also allows the practitioner to convert an
  2 11 endorsement issued under the prior rules to an endorsement
  2 12 issued on or after July 1, 2019, without fee if the
  2 13 practitioner meets the requirements for the new endorsement.
