Senate File 388 - Introduced SENATE FILE BY COMMITTEE ON STATE GOVERNMENT (SUCCESSOR TO SSB 1126) A BILL FOR 1 An Act relating to energy conservation requirements contained 2 within the state building code or adopted by governmental 3 subdivisions, and including retroactive applicability 4 provisions. 5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 2421SV (1) 87 gh/rn/nh PAG LIN 1 1 Section 1. Section 103A.8A, Code 2017, is amended to read 1 2 as follows: 1 3 103A.8A Energy conservation requirements. 1 4 1. The state building code commissioner shall adopt as 1 5 a part of the state building code a requirement that new 1 6 single=family or two=family residential construction shall 1 7 comply with energy conservation requirements. The requirements 1 8 adopted by the commissioner shall be based upon a nationally 1 9 recognized standard or code for energy conservation. The 1 10 requirements shall only apply to single=family or two=family 1 11 residential construction commenced after the adoption of 1 12 the requirements. Notwithstanding any other provision 1 13 of this chapter to the contrary, the energy conservation 1 14 requirements adopted by the commissioner and approved by 1 15 the council shall apply to new single=family or two=family 1 16 residential construction commenced on or after July 1, 2008, 1 17 andshall supersede and replace any minimum requirements for 1 18 energy conservation adopted or enacted by a governmental 1 19 subdivision prior to that date applicable to such construction 1 20to all single=family or two=family residential construction 1 21 commenced on or after July 1, 2010. The state building code 1 22 commissioner may provide training to builders, contractors, and 1 23 other interested persons on the adopted energy conservation 1 24 requirements. 1 25 2. If a governmental subdivision has adopted minimum 1 26 energy conservation requirements applicable to residential 1 27 construction described in subsection 1 that are not less 1 28 restrictive than the minimum energy conservation requirements 1 29 provided in the international energy conservation code, 2009 1 30 edition, then such residential construction shall comply 1 31 with the energy conservation requirements adopted by the 1 32 governmental subdivision in lieu of the energy conservation 1 33 requirements adopted by the commissioner. 1 34 Sec. 2. Section 103A.10, subsection 5, Code 2017, is amended 1 35 by striking the subsection. 2 1 Sec. 3. RETROACTIVE APPLICABILITY. This Act applies 2 2 retroactively to July 1, 2010. 2 3 EXPLANATION 2 4 The inclusion of this explanation does not constitute agreement with 2 5 the explanation's substance by the members of the general assembly. 2 6 This bill relates to energy conservation requirements 2 7 contained within the state building code or adopted by 2 8 governmental subdivisions. 2 9 Code chapter 103A requires new single=family or two=family 2 10 residential construction commenced on or after July 1, 2008, 2 11 to comply with energy conservation requirements adopted by 2 12 the state building code commissioner. "New construction", as 2 13 defined in the Code chapter, is expressly made inapplicable 2 14 to building renovations and repairs. The energy conservation 2 15 requirements adopted by the state building code commissioner 2 16 supersede and replace any minimum energy conservation 2 17 requirements adopted by a governmental subdivision. 2 18 The bill amends Code section 103A.8A to provide that all 2 19 single=family or two=family residential construction on or 2 20 after July 1, 2010, shall comply with the energy conservation 2 21 requirements, extending the requirements to existing residence 2 22 renovations and repairs. 2 23 The bill removes the language from Code section 103A.8A that 2 24 provides that the energy conservation requirements adopted 2 25 by the state building code commissioner are to supersede any 2 26 minimum requirements adopted by a governmental subdivision. 2 27 The bill makes conforming changes consistent with this 2 28 modification by striking Code section 103A.10(5). 2 29 The bill provides that if a governmental subdivision adopts 2 30 minimum energy conservation requirements that are not less 2 31 restrictive than the 2009 edition of the international energy 2 32 conservation code, then applicable residential construction 2 33 must comply with the energy conservation requirements 2 34 adopted by the governmental subdivision in lieu of the energy 2 35 conservation requirements adopted by the commissioner. 3 1 The bill applies retroactively to July 1, 2010.
