  1 An Act relating to the confidentiality of personally
  2    identifiable information of holders of nonprofessional
  3    permits to carry weapons and to acquire pistols or
  4    revolvers.

  1  1    Section 1.  Section 724.23, Code 2015, is amended to read as
  1  2 follows:
  1  3    724.23  Records kept by commissioner and issuing officers.
  1  4    1.  The commissioner of public safety shall maintain a
  1  5 permanent record of all valid permits to carry weapons and of
  1  6 current permit revocations.
  1  7    2.  a.  Notwithstanding any other law or rule to the
  1  8 contrary, the commissioner of public safety and any issuing
  1  9 officer shall keep confidential information that would
  1 10 personally identify holders of nonprofessional permits to carry
  1 11 weapons and permits to acquire pistols or revolvers, including
  1 12 but not limited to the name, social security number, date of
  1 13 birth, driver's license or other identification number, and
  1 14 residential or business address of the permit holder.
  1 15    b.  This subsection shall not prohibit the release of
  1 16 statistical information relating to the issuance, denial,
  1 17 revocation, or administration of nonprofessional permits to
  1 18 carry weapons and permits to acquire pistols or revolvers,
  1 19 provided that the release of such information does not reveal
  1 20 the identity of any individual permit holder.
  1 21    c.  This subsection shall not prohibit the release of
  1 22 information to any law enforcement agency, or an employee
  1 23 or agent thereof, when necessary for an investigation of
  1 24 a possible violation of law or for conducting a lawfully
  1 25 authorized background investigation.
  1 26                           EXPLANATION
  1 27 The inclusion of this explanation does not constitute agreement with
  1 28 the explanation's substance by the members of the general assembly.
  1 29    Current law requires the commissioner of public safety
  1 30 to maintain a permanent record of all valid permits to carry
  1 31 weapons and of current permit revocations.  The bill provides
  1 32 that, notwithstanding any other law or rule to the contrary,
  1 33 the commissioner of public safety and any issuing officer
  1 34 (county sheriff) shall keep confidential information that would
  1 35 personally identify holders of nonprofessional permits to carry
  2  1 weapons and permits to acquire pistols or revolvers, including
  2  2 but not limited to the name, social security number, date of
  2  3 birth, driver's license or other identification number, and
  2  4 residential or business address of the permit holder.  The
  2  5 bill does not prohibit the release of statistical information
  2  6 relating to the issuance, denial, revocation, or administration
  2  7 of nonprofessional permits to carry weapons and permits to
  2  8 acquire pistols or revolvers if such information does not
  2  9 reveal the identity of any individual permit holder, or the
  2 10 release of information to any law enforcement agency, or an
  2 11 employee or agent thereof, when necessary for an investigation
  2 12 of a possible violation of law or for conducting a lawfully
  2 13 authorized background investigation.
