S.F. 485 Section 1. Section 282.18, subsection 8, paragraph b, Code 1 2023, is amended to read as follows: 2 b. (1) A receiving district may send school vehicles more 3 than two miles into the district of residence of the pupil 4 using the open enrollment option under this section, for the 5 purpose of transporting the pupil to and from school in the 6 receiving district, if the boards of both the sending and 7 receiving districts agree to this arrangement. 8 (2) A receiving district may send school vehicles not more 9 than two miles into the district of residence of the pupil 10 using the open enrollment option under this section, for the 11 purpose of transporting the pupil to and from school in the 12 receiving district, without entering into an agreement with the 13 board of the sending district. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to the transportation to and from school 18 of pupils participating in open enrollment. Current law 19 authorizes a receiving school district to send school vehicles 20 into the district of residence of a pupil who open enrolls, 21 for the purpose of transporting the pupil to and from school 22 in the receiving school district, if the boards of directors 23 of the sending school district and receiving school district 24 agree to this arrangement. The bill strikes the requirement 25 that the boards of directors of the sending school district and 26 receiving school district agree to the arrangement in cases 27 where the receiving district’s school vehicles do not travel 28 more than two miles into the pupil’s district of residence. 29 -1- LSB 1044SV (3) 90 jda/jh 1/ 1
