Section
1.
Section
135.101,
Code
2023,
is
amended
to
read
1
as
follows:

135.101
Childhood
lead
poisoning
prevention
program.

There
is
established
a
childhood
lead
poisoning
prevention
4
program
within
the
Iowa
department
of
public
health
.
The
5
department
shall
implement
and
review
programs
necessary
to
6
eliminate
potentially
dangerous
toxic
lead
levels
in
children
7
in
Iowa
in
a
year
for
which
funds
are
appropriated
to
the
8
department
for
this
purpose
.
The
program
guidelines
shall
be
9
based
on
the
maximum
blood
lead
level
in
children
as
specified
10
by
rule
of
the
department
and
shall
provide
for
responsive
11
action,
including
but
not
limited
to
case
management
services
12
for
children
and
the
provision
of
available
home
intervention
13
and
target
housing
resources,
when
the
maximum
level
is
met
14
or
exceeded
in
accordance
with
the
most
recent
recommended
15
actions
based
on
blood
lead
level
published
by
the
centers
for
16
disease
control
and
prevention
of
the
United
States
department
17
of
health
and
human
services.

Section
135.102,
subsections
3
and
6,
Code
2023,
are
19
amended
to
read
as
follows:

Maximum
The
maximum
blood
lead
levels
level
in
children
21
living
in
targeted
rental
dwelling
units
that
is
the
level
of
22
lead
in
the
bloodstream
that
equals
or
exceeds
the
lower
of
23
three
and
one-half
micrograms
of
lead
per
deciliter
of
blood,
24
or
an
amount
identified
in
the
most
recent
recommendations
by
25
the
centers
for
disease
control
and
prevention
of
the
United
26
States
department
of
health
and
human
services,
and
that
27
necessitates
the
undertaking
of
responsive
action,
including
28
but
not
limited
to
case
management
services
for
children
and
29
the
provision
of
available
home
intervention
and
target
housing
30
resources
.

6.
Model
regulations
Guidelines,
as
specified
in
section
32
135.105B,
for
lead
hazard
remediation
to
be
used
by
the
33
state
and
in
local
programs
in
instances
in
which
a
child
is
34
confirmed
as
lead
poisoned.
The
department
shall
make
the

model
regulations
guidelines
available
to
local
boards
of

health
and
shall
promote
the
adoption
of
the
regulations
to
be

used
at
the
local
level,
in
cities
and
counties
implementing

lead
hazard
remediation
programs
to
provide
consistency

throughout
the
state
.
Nothing
in
this
subsection
shall
be
5
construed
as
requiring
the
adoption
of
the
model
regulations.

3.
Section
135.103,
Code
2023,
is
amended
to
read
as
7
follows:

135.103
Grant
program.

The
department
shall
implement
a
childhood
lead
poisoning
10
prevention
grant
program
which
provides
federal,
state,
or
11
other
funds
to
local
boards
of
health
or
cities
and
counties
12
for
the
program
after
standards
and
requirements
for
the
13
local
program
are
developed
consistent
with
the
most
recent
14
recommendations
regarding
the
maximum
blood
lead
level
and
15
recommended
actions
based
on
blood
lead
level
published
by
16
the
centers
for
disease
control
and
prevention
of
the
United
17
States
department
of
health
and
human
services
.
The
department
18
may
also
use
federal,
state,
or
other
funds
provided
for
the
19
childhood
lead
poisoning
prevention
grant
program
to
purchase
20
environmental
and
blood
testing
services
from
a
public
health
21
laboratory.

Sec.
4.
Section
135.105B,
Code
2023,
is
amended
by
striking
23
the
section
and
inserting
in
lieu
thereof
the
following:

Guidelines
for
local
lead
hazard
remediation
25
programs.

1.
The
department
shall
develop
guidelines
to
be
used
by
27
local
programs
that
administer
lead
hazard
remediation
programs
28
to
address
the
health
and
environmental
needs
of
children
who
29
are
confirmed
as
lead
poisoned.
30
2.
The
guidelines
shall
be
based
on
the
most
recent
31
guidelines
published
by
the
centers
for
disease
control
and
32
prevention
of
the
United
States
department
of
health
and
human
33
services
for
recommended
actions
based
on
blood
lead
level
and
34
shall
reflect
the
maximum
blood
lead
level
specified
by
rule

the

A
city
or
county
may
elect
to
administer
a
local
program

through
a
city
or
county
health
department
on
a
city,
county,

or
multicounty
basis
or
may
request
that
the
state

and

This
bill
amends
provisions
relating
to
the
childhood
lead

poisoning
prevention
program
(program)
in
the
department
of
10
health
and
human
services
(HHS)
to
align
maximum
blood
lead
11
level
provisions
and
program
activities
with
the
most
recent
12
maximum
lead
level
in
children
specified
by
the
centers
for
13
disease
control
and
prevention
(CDC)
and
the
recommended
14
actions
based
on
the
CDC
blood
lead
level.

The
bill
requires
HHS
guidelines
for
the
program
to
be
based
16
on
the
maximum
blood
lead
level
in
children
as
specified
by
17
rule
of
HHS
and
shall
provide
for
responsive
action,
including
18
but
not
limited
to
case
management
services
for
children
19
and
the
provision
of
available
home
intervention
and
target
20
housing
resources,
when
the
maximum
level
is
met
or
exceeded
in
21
accordance
with
the

recent
recommended
actions

the

The
bill
requires

to

rules
for

be

lead
level

and

the

by
rule
of

The
bill
continues
the
current
option
under
the
program

for
a
city
or
county
to
elect
to
administer
a
local
program
11
through
a
city
or
county
health
department
on
a
city,
county,

or
multicounty
basis
or
to
request
that
the
state
develop
and

administer
the
local
program.
