Section
1.
Section
321.373,
Code
2019,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
7A.
a.
A
new
school
bus
ordered
for
3
purchase
by
a
school
district
on
or
after
the
effective
date
4
of
this
Act
shall
be
equipped
with
a
stop
arm
camera
mounted
to
5
the
school
bus
stop
arm.
6
b.
A
school
bus
placed
in
service
for
which
the
requirements
7
of
paragraph
“a”
do
not
apply
shall
be
equipped
with
a
stop
8
arm
camera
mounted
to
the
school
bus
stop
arm
within
two
years
9
following
the
effective
date
of
this
Act.
10
c.
The
rules
prescribed
for
school
buses
under
this
section
11
shall
conform
to
the
requirements
of
this
subsection.

Sec.
2.
Section
285.8,
subsection
6,
paragraph
d,
Code
2019,
13
is
amended
to
read
as
follows:

d.
For
standard
of
safety
in
construction
of
school
15
transportation
equipment.
Consistent
with
subsection
5,
16
standards
established
by
the
department
under
this
paragraph
17
shall
conform
to
the
requirements
of
section
321.373,

subsection
7A.

Sec.
3.
Section
298.3,
subsection
1,
paragraph
i,
Code
2019,
20
is
amended
to
read
as
follows:

i.
The
purchase
of
transportation
equipment
for
22
transporting
students
and
the
repair
of
such
transportation
23
equipment
if
the
cost
of
the
repair
exceeds
two
thousand
five
24
hundred
dollars.
For
the
purposes
of
this
paragraph,
“repair”
25
means
restoring
an
existing
item
of
equipment
to
its
original
26
condition,
as
near
as
may
be,
after
gradual
obsolescence
or
27
physical
and
functional
depreciation
due
to
wear
and
tear,
28
corrosion
and
decay,
or
partial
destruction,
and
includes
29
maintenance
of
an
item
of
equipment
or
the
modification
of
30
an
item
of
equipment
to
comply
with
construction
or
safety
31
standards,
including
the
requirements
of
section
321.373,

subsection
7A
.

Sec.
4.
Section
423F.3,
subsection
6,
Code
2019,
is
amended

by
adding
the
following
new
paragraph:

“school
infrastructure”

includes
the
cost
of
the
modification
of
an
item
of
school

transportation
equipment
to
comply
with
construction
or
safety

standards,
including
the
requirements
of
section
321.373,

Sec.
5.
STATE
MANDATE
FUNDING
SPECIFIED.
In
accordance
6
with
section
25B.2,
subsection
3,
the
state
cost
of
requiring
7
compliance
with
any
state
mandate
included
in
this
Act
shall
8
be
paid
by
a
school
district
from
state
school
foundation
9
aid
received
by
the
school
district
under
section
257.16,
a
10
physical
plant
and
equipment
levy
under
section
298.2,
or
from
11
revenues
from
the
secure
an
advanced
vision
for
education
12
fund
under
chapter
423F.
This
specification
of
the
payment
13
of
the
state
cost
shall
be
deemed
to
meet
all
of
the
state
14
funding-related
requirements
of
section
25B.2,
subsection
3,
15
and
no
additional
state
funding
shall
be
necessary
for
the
16
full
implementation
of
this
Act
by
and
enforcement
of
this
Act
17
against
all
affected
school
districts.
18
Sec.
6.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
19
importance,
takes
effect
upon
enactment.

EXPLANATION
21
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
school
bus
equipment
standards
and
24
requirements.
25
Code
section
321.373
requires
every
school
bus
except
26
private
passenger
vehicles
used
as
school
buses
to
be
27
constructed
and
equipped
to
meet
safety
standards
prescribed
28
in
rules
adopted
by
the
state
board
of
education.
The
bill
29
requires
a
new
school
bus
ordered
for
purchase
by
a
school
30
district
on
or
after
the
effective
date
of
this
bill
to
be
31
equipped
with
a
stop
arm
camera
mounted
to
the
school
bus
stop
32
arm
and
requires
existing
school
buses
to
be
equipped
with
stop
33
arm
cameras
mounted
to
the
school
bus
stop
arm
within
two
years
34
following
the
effective
date
of
the
bill.

section

enumerates
the
powers
and
duties
of
the

department
of
education
relating
to
the
transportation
of
2
children,
including
aiding
in
the
enforcement
of
the
motor
3
vehicle
laws
relating
to
the
transportation
of
school
children
4
and
including
prescribing
uniform
standards
and
regulations
for
5
safety
in
construction
of
school
transportation
equipment.
The
6
bill
requires
the
standards
established
by
the
department
of
7
education
relating
to
the
standard
of
safety
in
construction
8
of
school
transportation
equipment
to
conform
to
the
stop
arm
9
camera
requirements
established
in
the
bill.
10
The
bill
may
include
a
state
mandate
as
defined
in
Code
11
section
25B.3.
The
bill
requires
that
the
state
cost
of
12
any
state
mandate
included
in
the
bill
be
paid
by
a
school
13
district
from
state
school
foundation
aid
received
by
the
14
school
district
under
Code
section
257.16,
a
physical
plant
and
15
equipment
levy
under
Code
section
298.2,
or
from
revenues
from
16
the
secure
an
advanced
vision
for
education
fund
under
Code
17
chapter
423F.
The
specification
is
deemed
to
constitute
state
18
compliance
with
any
state
mandate
funding-related
requirements

of
Code

The

the

subdivisions

effect
