S.F. 51 Section 1. Section 257.35, subsection 1, Code 2011, is 1 amended to read as follows: 2 1. The For school budget years ending prior to July 1, 3 2012, the department of management shall deduct the amounts 4 calculated for special education support services, media 5 services, area education agency teacher salary supplement 6 district cost, area education agency professional development 7 supplement district cost, and educational services for each 8 school district from the state aid due to the district pursuant 9 to this chapter and shall pay the amounts to the respective 10 area education agencies on a monthly basis from September 15 11 through June 15 during each school year. The department of 12 management shall notify each school district of the amount 13 of state aid deducted for these purposes and the balance of 14 state aid shall be paid to the district. If a district does 15 not qualify for state aid under this chapter in an amount 16 sufficient to cover its amount due to the area education agency 17 as calculated by the department of management, the school 18 district shall pay the deficiency to the area education agency 19 from other moneys received by the district, on a quarterly 20 basis during each school year. 21 Sec. 2. NEW SECTION . 257.35A Area education agencies —— 22 state funding redirected. 23 1. Notwithstanding any provision of this chapter to the 24 contrary, for school budget years beginning on and after 25 July 1, 2012, the state aid funding for special education 26 support services, media services, and educational services, 27 as calculated by this chapter, shall be paid directly to the 28 applicable school district. 29 2. A school district receiving funding under subsection 1 30 shall choose one of the following options: 31 a. A school district may provide its own special education 32 services, media services, and educational services, as those 33 services are described in chapter 273. However, the school 34 district shall not receive funding for its costs that exceeds 35 -1- LSB 1477XS (2) 84 md/sc 1/ 3
S.F. 51 the amount determined under subsection 1, except for funds 1 received from another school district for providing special 2 education services, media services, or educational services to 3 such other school district. 4 b. A school district may solicit bids from organizations, 5 including other school districts and area education agencies, 6 to provide special education services, media services, and 7 educational services, as those services are described in 8 chapter 273. However, the school district soliciting bids 9 shall not receive funding for its costs that exceeds the amount 10 determined under subsection 1. 11 3. The department of education shall distribute the 12 appropriate amount of area education agency professional 13 development supplement and area education agency teacher salary 14 supplement funding to a school district if an area education 15 agency successfully bids to provide the services. 16 Sec. 3. Section 273.9, subsection 1, Code 2011, is amended 17 to read as follows: 18 1. School For school budget years ending prior to July 1, 19 2012, school districts shall pay for the programs and services 20 provided through the area education agency and shall include 21 expenditures for the programs and services in their budgets, in 22 accordance with this section . 23 Sec. 4. NEW SECTION . 273.9A Funding from school districts 24 —— state and local funds. 25 Notwithstanding any provision of this chapter to the 26 contrary, for school budget years beginning on and after July 27 1, 2012, an area education agency or other organization shall 28 receive state aid funding for providing special education 29 support services, media services, and educational services 30 from the applicable school district. Area education agencies 31 and other organizations may submit bids for providing special 32 education support services, media services, and educational 33 services in a process to be determined by the department of 34 education by rule under chapter 17A. 35 -2- LSB 1477XS (2) 84 md/sc 2/ 3
S.F. 51 Sec. 5. APPLICABILITY DATE. This Act applies to school 1 budget years beginning on and after July 1, 2012. 2 EXPLANATION 3 This bill enacts new Code section 257.35A, which directs 4 state aid funding for special education support services, 5 media services, educational services, area education agency 6 professional development supplement, and area education agency 7 teacher salary supplement to the applicable school districts. 8 The bill allows a school district to provide its own 9 services. A school district may also bid to provide services 10 to other school districts. A school district may also solicit 11 bids from organizations to receive these services. If a school 12 district provides its own special education support services, 13 media services, or educational services, it shall not receive 14 funding that exceeds the amount determined under new Code 15 section 257.35A. The bill requires area education agencies 16 (AEAs) and other organizations to bid to provide special 17 education support services, media services, and educational 18 services. An AEA or organization that successfully bids to 19 provide these services to a school district will receive the 20 appropriate amount of funding. The department of education is 21 tasked with developing the bid process by rule. 22 Currently, area education agency funding operates pursuant 23 to a “flow-through” concept. With no direct taxing authority, 24 AEAs rely on local school districts to generate funds for their 25 operation. While AEA funding is included within a school 26 district’s budget, the district does not actually receive 27 AEA-related state aid payments. Instead, funds generated by 28 the districts through the operation of the school finance 29 formula and earmarked for AEAs are subtracted by the department 30 of management from the state aid otherwise due to the district 31 and are paid directly to each AEA. 32 The bill applies to school budget years beginning on and 33 after July 1, 2012. 34 -3- LSB 1477XS (2) 84 md/sc 3/ 3
