1.
NEW
SECTION
.
135B.36
Hospital
policies
——
1
submission
to
department
——
posting.

1.
A
hospital
licensed
under
this
chapter
shall
no
later
3
than
September
1,
2023,
submit
to
the
department
its
policies
4
related
to
all
of
the
following:
5
a.
Admission.
6
b.
Nondiscrimination.
7
c.
Reproductive
health
care.

2.
The
department
shall
post
a
copy
of
the
policies
received
9
under
subsection
1
on
the
department’s
internet
site.
10
3.
If
a
hospital
makes
changes
or
additions
to
any
of
the
11
policies
specified
under
subsection
1,
the
hospital
shall
12
submit
a
copy
of
the
changed
or
added
policy
to
the
department
13
within
thirty
days
after
the
hospital
approves
the
change
or
14
addition.

4.
A
hospital
shall
post
a
copy
of
the
policies
provided
16
under
subsection
1
on
the
hospital’s
internet
site
where
17
the
policies
are
readily
accessible
to
the
public,
without
18
requiring
a
login
credential
or
other
restriction.

Sec.
2.
CODE
EDITOR
DIRECTIVE.
The
Code
editor
may
20
designate
section
135B.36,
as
enacted
in
this
Act,
as
a
new
21
subchapter
within
chapter
135B,
entitled
“submission
and
22
posting
of
hospital
policies”.

EXPLANATION
24
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
a
licensed
hospital,
no
later
than
27
September
1,
2023,
to
submit
to
the
department
of
inspections
28
and
appeals
(DIA)
its
policies
related
to
admission,
29
nondiscrimination,
and
reproductive
health
care.
DIA
shall
30
post
a
copy
of
the
policies
received
on
the
department’s
31
internet
site.
If
a
hospital
makes
changes
or
additions
to
32
any
of
the
policies,
the
hospital
shall
submit
a
copy
of
33
the
changed
or
added
policy
to
DIA
within
30
days
after
the
34
hospital
approves
the
change
or
addition.
