Section
1.
Section
321.1,
Code
2017,
is
amended
by
adding
1
the
following
new
subsection:
2
NEW
SUBSECTION
.
06B.
“Automated
traffic
law
enforcement
3
system”
means
a
device
that
is
used
for
the
enforcement
of
laws
4
regulating
vehicular
traffic
and
that
is
equipped
with
one
or
5
more
sensors
working
in
conjunction
with
one
of
the
following:
6
a.
An
official
traffic-control
signal,
to
produce
recorded
7
images
of
motor
vehicles
entering
an
intersection
against
a
red
8
signal
light.
9
b.
A
speed
measuring
device,
to
produce
recorded
images
of
10
motor
vehicles
traveling
at
a
prohibited
rate
of
speed.
11
c.
A
railroad
grade
crossing
signal
light,
as
described
12
in
section
321.342,
to
produce
recorded
images
of
vehicles
13
violating
the
signal
light.
14
d.
Any
official
traffic-control
device,
if
failure
to
comply
15
with
the
official
traffic-control
device
constitutes
a
moving
16
violation
under
this
chapter.

.
321.492C
Automated
traffic
law
18
enforcement
systems.
19
1.
The
department
shall
not
place,
cause
to
be
placed,
20
operate,
maintain,
or
employ
the
use
of
any
automated
traffic
21
law
enforcement
system.
22
2.
A
local
authority,
or
another
entity
on
a
local
23
authority’s
behalf,
shall
not
operate
an
automated
traffic
law
24
enforcement
system
without
the
approval
of
the
department.
25
The
department
shall
approve
the
operation
of
an
automated
26
traffic
law
enforcement
system
only
if
the
system
is
located
in
27
a
documented
high-crash
or
high-risk
location
and
there
is
a
28
demonstrated
safety
need
for
the
system.
The
department
shall
29
adopt
rules
to
administer
this
subsection.
30
3.
All
moneys
collected
by
a
local
authority
from
31
citations
issued
as
a
result
of
the
use
of
an
automated
32
traffic
law
enforcement
system,
less
the
amount
necessary
33
for
the
installation,
operation,
and
maintenance
of
the
34
automated
traffic
law
enforcement
system,
shall
be
deposited

the
account
or
accounts
maintained
by
the
local
authority
1
for
moneys
appropriated
to
the
local
authority
from
the
2
secondary
road
fund
or
street
construction
fund
of
the
cities,

as
applicable.
This
subsection
shall
not
apply
to
moneys
4
collected
for
court
costs
or
other
associated
costs,
the
5
criminal
penalty
surcharge
required
by
section
911.1,
or
the
6
county
enforcement
surcharge
required
by
section
911.4.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
the
department
of
transportation
(DOT)
11
from
placing,
causing
to
be
placed,
operating,
maintaining,
12
or
employing
the
use
of
any
automated
traffic
law
enforcement
13
system.
14
The
bill
prohibits
a
local
authority,
or
another
entity
on
a
15
local
authority’s
behalf,
from
operating
an
automated
traffic
16
law
enforcement
system
without
the
approval
of
the
DOT.
The
17
bill
provides
that
the
DOT
shall
approve
the
operation
of
an
18
automated
traffic
law
enforcement
system
only
if
the
system
is
19
located
in
a
documented
high-crash
or
high-risk
location
and
20
there
is
a
demonstrated
safety
need
for
the
system.

The
bill
also
requires
all
moneys
collected
by
a
local
22
authority
from
citations
issued
as
a
result
of
the
use
of
23
an
automated
traffic
law
enforcement
system,
less
the
amount
24
necessary
for
the
installation,
operation,
and
maintenance
25
of
the
system,
to
be
deposited
in
the
account
or
accounts
26
maintained
by
the
local
authority
for
moneys
appropriated
to
27
the
local
authority
from
the
secondary
road
fund
or
street
28
construction
fund
of
the
cities,
as
applicable.
This
provision
29
does
not
apply
to
moneys
collected
for
court
costs
or
other
30
associated
costs,
the
criminal
penalty
surcharge,
or
the
county
31
enforcement
surcharge.
