Section
1.
Section
321.271,
subsection
2,
Code
2023,
is
1
amended
to
read
as
follows:

2.
All
written
reports
filed
by
a
law
enforcement
officer
3
as
required
under
section
321.266
shall
be
made
available
to
4
any
party
to
an
accident,
the
party’s
insurance
company
or
5
its
agent,
the
party’s
attorney,
the
federal
motor
carrier
6
safety
administration,
or
the
attorney
general,
on
written
7
request
to
the
department
and
the
payment
of
a
fee
of
four
8
dollars
for
each
copy.
If
a
copy
of
an
investigating
officer’s
9
report
of
a
motor
vehicle
accident
filed
with
the
department
10
is
retained
by
the
law
enforcement
agency
of
the
officer
11
who
filed
the
report,
a
copy
shall
be
made
available
to
any
12
party
to
the
accident,
the
party’s
insurance
company
or
its
13
agent,
the
party’s
attorney,
the
federal
motor
carrier
safety
14
administration,
other
law
enforcement
agencies,
or
the
attorney
15
general,
on
written
request
and
the
payment
of
a
fee.
However,
16
the
attorney
general
and
the
federal
motor
carrier
safety
17
administration
shall
not
be
required
by
the
department
or
the
18
law
enforcement
agency
to
pay
a
fee
for
a
copy
of
a
report
filed
19
by
a
law
enforcement
or
investigating
officer.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
authorizes
a
copy
of
a
written
report
that
24
was
filed
with
the
department
of
transportation
by
a
law
25
enforcement
officer
who
investigated
a
motor
vehicle
accident
26
which
resulted
in
injury
to
or
death
of
any
person
or
total
27
property
damage
to
an
apparent
extent
of
$1,500
or
more,
and
28
that
was
retained
by
the
agency
of
the
officer
who
filed
the
29
report,
to
be
made
available
to
other
law
enforcement
agencies.

The
bill
does
not
apply
this
authorization
to
such
reports
that
31
were
not
retained
by
the
agency
of
the
officer.

Under
current
law,
a
person
eligible
to
receive
a
copy
of
33
the
report,
other
than
the
attorney
general
or
federal
motor
34
carrier
safety
administration,
must
make
a
written
request
and
