Section
1.
Section
322.3,
Code
2024,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
18.
A
motor
vehicle
dealer
licensed
under
3
this
chapter
shall
not
sell
or
conduct
a
retail
auction
of
4
a
motor
vehicle
acquired
from
a
person
not
within
this
state
5
unless
the
dealer
obtains
a
vehicle
history
report
for
the
6
vehicle.
For
purposes
of
this
subsection,
“vehicle
history
7
report”
means
a
report
detailing
previous
events
involving
a
8
vehicle
based
on
the
unique
vehicle
identification
number,
9
including
but
not
limited
to
events
relating
to
the
vehicle’s
10
title
and,
if
applicable,
recall
notifications,
insurance
11
claims,
accident
reports,
damage
reports,
and
theft
reports.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
a
licensed
motor
vehicle
dealer
from
16
selling
or
conducting
a
retail
auction
of
a
motor
vehicle
17
acquired
from
a
person
not
within
Iowa
unless
the
dealer
first
18
obtains
a
vehicle
history
report.
The
bill
defines
“vehicle
19
history
report”.

Current
law
requires
a
person
engaged
in
the
business
of
21
selling
motor
vehicles
to
apply
for
and
obtain
a
motor
vehicle
22
dealer
license.
The
department
of
transportation
may
deny,
23
suspend,
or
revoke
a
motor
vehicle
dealer
license
held
by
a
24
person
who
has
not
complied
with
the
provisions
of
Code
chapter
25
322,
including
the
provisions
of
the
bill,
or
associated
26
administrative
rules.
By
operation
of
law,
a
person
who
27
violates
the
bill
is
guilty
of
a
simple
misdemeanor
punishable
28
by
a
fine
of
not
less
than
$250
nor
more
than
$1,500
or
by
29
imprisonment
not
to
exceed
30
days.
