There is appropriated from the general fund of the state 4 to the department of justice for the fiscal year beginning July 5 1, 2024, and ending June 30, 2025, the following amounts, or 6 so much thereof as is necessary, to be used for the purposes 7 designated: 8 a. For the general office of attorney general for 9 salaries, support, maintenance, and miscellaneous purposes, 10 including the prosecuting attorneys training program, matching 11 funds for federal violence against women grant programs, 12 victim assistance grants, the office of drug control policy 13 prosecuting attorney program, and odometer fraud enforcement: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 9,042,483 15 As a condition of receiving the appropriation provided 16 in this lettered paragraph, the department of justice shall 17 maintain a record of the estimated time incurred representing 18 each agency or department. 19 The general office of attorney general may temporarily 20 exceed and draw more than the amount appropriated in this 21 lettered paragraph and incur a negative cash balance as long 22 as there are receivables equal to or greater than the negative 23 balances and the amount appropriated in this lettered paragraph 24 is not exceeded at the close of the fiscal year. 25 b. For victim assistance grants: 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,016,708 27 The moneys appropriated in this lettered paragraph shall be 28 used to provide grants to care providers providing services to 29 crime victims of domestic abuse or to crime victims of rape and 30 sexual assault. 31 The balance of the victim compensation fund established in 32 section 915.94 may be used to provide salary and support of not 33 more than 24.00 full-time equivalent positions and to provide 34 maintenance for the victim compensation functions of the 35 -1- LSB 5014XG (5) 90 as/ns 1/ 19

In addition to the full-time equivalent 1 positions authorized pursuant to this paragraph, 7.00 full-time 2 equivalent positions are authorized and shall be used by the 3 department of justice to employ one accountant and four program 4 planners. The department of justice may employ the additional 5 7.00 full-time equivalent positions authorized pursuant to 6 this paragraph that are in excess of the number of full-time 7 equivalent positions authorized only if the department 8 of justice receives sufficient federal moneys to maintain 9 employment for the additional full-time equivalent positions 10 during the current fiscal year. The department of justice 11 shall only employ the additional 7.00 full-time equivalent 12 positions in succeeding fiscal years if sufficient federal 13 moneys are received during each of those succeeding years. 14 The department of justice shall transfer at least $150,000 15 from the victim compensation fund established in section 915.94 16 to the victim assistance grant program established in section 17 13.31. 18 Notwithstanding section 8.33, moneys appropriated in this 19 lettered paragraph that remain unencumbered or unobligated at 20 the close of the fiscal year shall not revert but shall remain 21 available for expenditure for the purposes designated until the 22 close of the succeeding fiscal year. 23 c. The department of justice, in submitting budget 30 estimates for the fiscal year beginning July 1, 2025, pursuant 31 to section 8.23, shall include a report of funding from sources 32 other than amounts appropriated directly from the general fund 33 of the state to the department of justice or to the office of 34 consumer advocate. These funding sources shall include but 35 -2- LSB 5014XG (5) 90 as/ns 2/ 19
S.F. _____ H.F. _____ are not limited to reimbursements from other state agencies, 1 commissions, boards, or similar entities, and reimbursements 2 from special funds or internal accounts within the department 3 of justice. The department of justice shall also report actual 4 reimbursements for the fiscal year beginning July 1, 2023, 5 and actual and expected reimbursements for the fiscal year 6 beginning July 1, 2024. 7 b. The department of justice shall include the report 8 required under paragraph “a”, as well as information regarding 9 any revisions occurring as a result of reimbursements actually 10 received or expected at a later date, in a report to the 11 general assembly. The department of justice shall submit the 12 report on or before January 15, 2025. 13 3. a. The department of justice shall fully reimburse 14 the costs and necessary related expenses incurred by the Iowa 15 law enforcement academy to continue to employ one additional 16 instructor position who shall provide training for human 17 trafficking-related issues throughout the state. 18 b. The department of justice shall obtain the moneys 19 necessary to reimburse the Iowa law enforcement academy to 20 employ such an instructor from unrestricted moneys from either 21 the victim compensation fund established in section 915.94 or 22 the human trafficking victim fund established in section 915.95 23 or the human trafficking enforcement fund established in 2015 24 Iowa Acts, chapter 138, section 141. 25 Sec. 2. OFFICE OF CONSUMER ADVOCATE. It is the intent of the general assembly that each 9 lease negotiated by the department of corrections with a 10 private corporation for the purpose of providing private 11 industry employment of inmates in a correctional institution 12 shall prohibit the private corporation from utilizing inmate 13 labor for partisan political purposes for any person seeking 14 election to public office in this state and that a violation 15 of this requirement shall result in a termination of the lease 16 agreement. 17 b. It is the intent of the general assembly that as a 18 condition of receiving the appropriation provided in this 19 subsection the department of corrections shall not enter into 20 a lease or contractual agreement pursuant to section 904.809 21 with a private corporation for the use of building space for 22 the purpose of providing inmate employment without providing 23 that the terms of the lease or contract establish safeguards to 24 restrict, to the greatest extent feasible, access by inmates 25 working for the private corporation to personal identifying 26 information of citizens. 27 2. The director of the department of corrections may 1 transfer moneys from Iowa prison industries and the canteen 2 operating funds established pursuant to section 904.310, for 3 use in educational programs for inmates. 4 c. Notwithstanding section 8.33, moneys appropriated in 5 this subsection that remain unencumbered or unobligated at the 6 close of the fiscal year shall not revert but shall remain 7 available to be used only for the purposes designated in this 8 subsection until the close of the succeeding fiscal year. 9 3. Each judicial district department of correctional 32 services, within the moneys available, shall continue programs 33 and plans established within that district to provide for 34 intensive supervision, sex offender treatment, diversion of 35 -8- LSB 5014XG (5) 90 as/ns 8/ 19
S.F. _____ H.F. _____ low-risk offenders to the least restrictive sanction available, 1 job development, and expanded use of intermediate criminal 2 sanctions. 3 3. Each judicial district department of correctional 4 services shall provide alternatives to prison consistent with 5 chapter 901B. The alternatives to prison shall ensure public 6 safety while providing maximum rehabilitation to the offender. 7 A judicial district department of correctional services may 8 also establish a day program. 9 4. The office of drug control policy of the department 10 of public safety shall consider federal grants made to the 11 department of corrections for the benefit of each of the eight 12 judicial district departments of correctional services as local 13 government grants, as defined pursuant to federal regulations. 14 5. The department of corrections shall continue to contract 15 with a judicial district department of correctional services to 16 provide for the rental of electronic monitoring equipment which 17 shall be available statewide. 18 6. The public safety assessment shall not be utilized in 19 pretrial hearings when determining whether to detain or release 20 a defendant before trial until such time the use of the public 21 safety assessment has been specifically authorized by the 22 general assembly. 23 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 24 APPROPRIATIONS. Notwithstanding section 8.39, within the 25 moneys appropriated in this division of this Act to the 26 department of corrections, the department may reallocate the 27 moneys appropriated and allocated as necessary to best fulfill 28 the needs of the correctional institutions, administration 29 of the department, and the judicial district departments of 30 correctional services. However, in addition to complying with 31 the requirements of sections 904.116 and 905.8 and providing 32 notice to the legislative services agency, the department 33 of corrections shall also provide notice to the department 34 of management, prior to the effective date of the revision 35 -9- LSB 5014XG (5) 90 as/ns 9/ 19
S.F. _____ H.F. _____ or reallocation of an appropriation made pursuant to this 1 section. The department of corrections shall not reallocate an 2 appropriation or allocation for the purpose of eliminating any 3 program. 4 Sec. 7. INTENT —— REPORTS. 5 1. The department of corrections, in cooperation with 6 townships, the Iowa cemetery associations, and other nonprofit 7 or governmental entities, may use inmate labor during the 8 fiscal year beginning July 1, 2024, to restore or preserve 9 rural cemeteries and historical landmarks. The department, in 10 cooperation with the counties, may also use inmate labor to 11 clean up roads, major water sources, and other water sources 12 around the state. 13 2. By January 15, 2025, the department shall provide an 14 annual status report regarding private-sector employment to 15 the general assembly. The report shall include the number 16 of offenders employed in the private sector, the combined 17 number of hours worked by the offenders, the total amount of 18 allowances, and the distribution of allowances pursuant to 19 section 904.702, including any moneys deposited in the general 20 fund of the state. 21 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 22 corrections shall submit a report on electronic monitoring 23 to the general assembly by January 15, 2025. The report 24 shall specifically address the number of persons being 25 electronically monitored and break down the number of persons 26 being electronically monitored by offense committed. The 27 report shall also include a comparison of any data from the 28 prior fiscal year with the current fiscal year. 29 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 30 1. As used in this section, unless the context otherwise 31 requires, “state agency” means the government of the state 32 of Iowa, including but not limited to all executive branch 33 departments, agencies, boards, bureaus, and commissions, the 34 judicial branch, the general assembly and all legislative 35 -10- LSB 5014XG (5) 90 as/ns 10/ 19
S.F. _____ H.F. _____ agencies, institutions within the purview of the state board of 1 regents, and any corporation whose primary function is to act 2 as an instrumentality of the state. 3 2. State agencies are encouraged to purchase products from 4 Iowa state industries, as defined in section 904.802, when 5 purchases are required and the products are available from 6 Iowa state industries. State agencies shall obtain bids from 7 Iowa state industries for purchases of office furniture during 8 the fiscal year beginning July 1, 2024, exceeding $5,000 or 9 in accordance with applicable administrative rules related to 10 purchases for the agency. 11 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 12 1. There is appropriated from the general fund of the 13 state to the Iowa law enforcement academy for the fiscal year 14 beginning July 1, 2024, and ending June 30, 2025, the following 15 amount, or so much thereof as is necessary, to be used for the 16 purposes designated: 17 a. For salaries, support, maintenance, and miscellaneous 18 purposes, including jailer training and technical assistance: 19 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,904,407 20 b. The Iowa law enforcement academy may temporarily exceed 21 and draw more than the amount appropriated in this subsection 22 and incur a negative cash balance as long as there are 23 receivables equal to or greater than the negative balance and 24 the amount appropriated in this subsection is not exceeded at 25 the close of the fiscal year. 26 2. The Iowa law enforcement academy may select at least 27 five automobiles of the department of public safety, division 28 of state patrol, prior to turning over the automobiles to 29 the department of administrative services to be disposed 30 of by public auction, and the Iowa law enforcement academy 31 may exchange any automobile owned by the academy for each 32 automobile selected if the selected automobile is used in 33 training law enforcement officers at the academy. However, any 34 automobile exchanged by the academy shall be substituted for 35 -11- LSB 5014XG (5) 90 as/ns 11/ 19
S.F. _____ H.F. _____ the selected vehicle of the department of public safety and 1 sold by public auction with the receipts being deposited in the 2 depreciation fund maintained pursuant to section 8A.365 to the 3 credit of the department of public safety, division of state 4 patrol. 5 3. The Iowa law enforcement academy shall provide training 6 for domestic abuse and human trafficking-related issues 7 throughout the state. The training shall be offered at no 8 cost to the attendees and the training shall not replace any 9 existing domestic abuse or human trafficking training offered 10 by the academy. 11 Sec. 11. STATE PUBLIC DEFENDER. 12 1. There is appropriated from the general fund of the state 13 to the office of the state public defender of the department 14 of inspections, appeals, and licensing for the fiscal year 15 beginning July 1, 2024, and ending June 30, 2025, the following 16 amounts, or so much thereof as is necessary, to be used for the 17 purposes designated: 18 a. Section 80B.11B, subsection 2, paragraph c, Code 19 2024, is amended to read as follows: 20 c. For a candidate sponsored by a political subdivision 21 and hired by the political subdivision, to the political 22 subdivision, one-third of the total cost ; to the candidate, 23 one-third of the total cost; and to the state, the remainder of 24 the total cost. The political subdivision may pay for all or a 25 portion of the candidate’s share of the costs. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to and makes appropriations to the justice 30 system. The bill is organized in divisions. 31 FY 2024-2025 APPROPRIATIONS. S.F. _____ H.F. _____ the Iowa law enforcement academy, office of the state public 1 defender, and board of parole. 2 The bill appropriates moneys from the commerce revolving 3 fund to the office of consumer advocate of the department 4 of justice; from the gaming enforcement revolving fund to 5 the department of public safety; from the 911 emergency 6 communications fund to the department of homeland security 7 and emergency management; and from the consumer education and 8 litigation fund to the department of justice for farm mediation 9 services and for criminal prosecutions, criminal appeals, and 10 performing certain duties. 11 IOWA LAW ENFORCEMENT ACADEMY. For a basic training course 12 provided to a candidate sponsored by a political subdivision 13 and hired by the political subdivision, current law requires 14 the Iowa law enforcement academy to charge one-third of the 15 cost to the political subdivision, one-third to the candidate, 16 and the remainder to the state.
