3 | everything after the enacting clause with the following:

4 | "Section 5. The Boxing and Full-contact Martial Arts Act is | ||||||
5 | amended by changing Section 1 and by adding Section 6.5 as | ||||||
6 | follows:

| ||||||
9 | Sec. 1. Short title and definitions.
| ||||||
10 | (a) This Act may be cited as the Boxing and Full-contact | ||||||
11 | Martial Arts Act.
| ||||||
12 | (b) As used in this Act:
| ||||||
13 | "Department" means the Department of Financial and
| ||||||
14 | Professional Regulation.
| ||||||
15 | "Secretary" means the Secretary
of Financial and | ||||||
16 | Professional Regulation.

| |||||||
| |||||||
1 | "Board" means the State of Illinois Athletic Board
| ||||||
2 | established pursuant to this Act.
| ||||||
3 | "License" means the license issued for
promoters,
| ||||||
4 | professionals, or officials
in accordance with this Act.
| ||||||
5 | "Professional contest" means a
boxing or full-contact | ||||||
6 | martial arts competition in which all of the participants | ||||||
7 | competing against one another are professionals and where | ||||||
8 | the public is able to attend or a fee is charged.
| ||||||
9 | "Permit" means the authorization from the Department | ||||||
10 | to a
promoter
to conduct professional or amateur contests, | ||||||
11 | or a combination of both.
| ||||||
12 | "Promoter" means a person who is licensed and
who
holds | ||||||
13 | a permit to conduct professional or amateur contests, or a | ||||||
14 | combination of both.
| ||||||
15 | Unless the context indicates otherwise, "person" | ||||||
16 | includes, but is not limited to, an individual,
| ||||||
17 | association, organization, business entity, gymnasium, or | ||||||
18 | club.
| ||||||
19 | "Judge" means a person licensed by the Department who | ||||||
20 | is
located at ringside or adjacent to the fighting area
| ||||||
21 | during a professional contest
and who has the | ||||||
22 | responsibility of scoring the performance of the
| ||||||
23 | participants in that professional contest.
| ||||||
24 | "Referee" means a person licensed by the Department who
| ||||||
25 | has the
general
supervision of
and is present inside of the | ||||||
26 | ring or fighting area during a professional contest.

| |||||||
1 | "Amateur" means a person registered by the Department | ||||||
2 | who is not competing for, and has never received or
| ||||||
3 | competed for, any
purse or other
article of value, directly | ||||||
4 | or indirectly, either for participating in any contest or | ||||||
5 | for the
expenses of training therefor,
other than a | ||||||
6 | non-monetary prize that does not exceed $50 in value.
| ||||||
7 | "Professional" means a person licensed by the
| ||||||
8 | Department who
competes for a
money prize, purse, or other | ||||||
9 | type of compensation in a professional contest held in
| ||||||
10 | Illinois.
| ||||||
11 | "Second" means a person licensed by the Department who | ||||||
12 | is
present at any professional
contest to provide | ||||||
13 | assistance or advice to a professional during the contest.
| ||||||
14 | "Matchmaker" means a person licensed by the Department | ||||||
15 | who
brings
together professionals to compete in
contests.
| ||||||
16 | "Manager" means a person licensed by the Department who | ||||||
17 | is
not a
promoter and
who, under contract, agreement, or | ||||||
18 | other arrangement, undertakes
to, directly or
indirectly, | ||||||
19 | control or administer the affairs of professionals.
| ||||||
20 | "Timekeeper" means a person licensed by the Department | ||||||
21 | who
is the
official timer of
the length of rounds and the | ||||||
22 | intervals between the rounds.
| ||||||
23 | "Purse" means the financial guarantee or any other
| ||||||
24 | remuneration for
which contestants
are participating in a | ||||||
25 | professional contest.
| ||||||
26 | "Physician" means a person licensed to practice |
| |||||||
| |||||||
1 | medicine
in all its
branches under the Medical Practice Act | ||||||
2 | of 1987.
| ||||||
3 | "Martial arts" means a discipline or combination of | ||||||
4 | different disciplines that utilizes sparring techniques | ||||||
5 | without the intent to injure, disable, or incapacitate | ||||||
6 | one's opponent, such as, but not limited to, Karate, Kung | ||||||
7 | Fu, Judo, Jujutsu, Tae Kwon Do, and Kyuki-Do. | ||||||
8 | "Full-contact martial arts" means the use of a singular | ||||||
9 | discipline or a combination of techniques from different | ||||||
10 | disciplines of the martial arts, including, without | ||||||
11 | limitation, full-force grappling, kicking, and striking | ||||||
12 | with the intent to injure, disable, or incapacitate one's | ||||||
13 | opponent.
| ||||||
14 | "Amateur contest" means a boxing or full-contact | ||||||
15 | martial arts competition in which all of the participants | ||||||
16 | competing against one another are amateurs and where the | ||||||
17 | public is able to attend or a fee is charged. | ||||||
18 | "Contestant" means a person who competes in either a | ||||||
19 | boxing or full-contact martial arts contest. | ||||||
20 | "Address of record" means the designated address | ||||||
21 | recorded by the Department in the applicant's or licensee's | ||||||
22 | application file, license file, or registration file as | ||||||
23 | maintained by the Department's licensure maintenance unit. | ||||||
24 | It is the duty of the applicant or licensee to inform the | ||||||
25 | Department of any change of address and those changes must | ||||||
26 | be made either through the Department's website or by |
| |||||||
| |||||||
1 | contacting the Department. | ||||||
2 | "Bout" means one match between 2 contestants. | ||||||
3 | "Sanctioning body" means an organization approved by | ||||||
4 | the Department under the requirements and standards stated | ||||||
5 | in this Act and the rules adopted under this Act to act as | ||||||
6 | a governing body that sanctions professional or amateur | ||||||
7 | contests. | ||||||
8 | "Elimination tournament" means a combative sports | ||||||
9 | contest in which the contestants compete in a series of | ||||||
10 | matches until not more than one contestant remains in any | ||||||
11 | weight category. | ||||||

14 | (225 ILCS 105/6.5 new) | ||||||
15 | Sec. 6.5. Elimination tournaments. | ||||||
16 | (a) All elimination tournaments conducted in this State | ||||||
17 | must be conducted in accordance with this Section. | ||||||
18 | (b) Before the start of any elimination tournament, the | ||||||
19 | Department shall check all promoters,
professionals, and | ||||||
20 | officials
associated with the elimination tournament for | ||||||
21 | licenses issued by the Department. Any individual without a | ||||||
22 | current license or registered issued by the Commission shall | ||||||
23 | not participate in the event. | ||||||
24 | (c) The promoter of an elimination tournament must: | ||||||
25 | (1) complete an application provided by the |
| |||||||
| |||||||
1 | Department; | ||||||
2 | (2) provide a surety bond, cash, certificate of | ||||||
3 | deposit, or other form of security acceptable to the | ||||||
4 | Department in the amount of $5,000; the Department may | ||||||
5 | increase the security as circumstances warrant; | ||||||
6 | (3) provide medical insurance in the amount of at least | ||||||
7 | $10,000 for each participant; and | ||||||
8 | (4) submit a $50 permit fee. | ||||||
9 | In addition, the promoter of an elimination tournament | ||||||
10 | must: | ||||||
11 | (A) arrange for an ambulance to be on site at each | ||||||
12 | event with emergency medical personnel and proper | ||||||
13 | resuscitation equipment; | ||||||
14 | (B) provide 16-ounce boxing gloves that shall be worn | ||||||
15 | by all participants; | ||||||
16 | (C) provide headgear that shall be worn by all | ||||||
17 | participants; | ||||||
18 | (D) provide adequate security at each event; and | ||||||
19 | (E) arrange spectator seating at least 6 feet away from | ||||||
20 | the ring apron. | ||||||
21 | The promoter of an elimination tournament may act as a | ||||||
22 | matchmaker for the purposes of arranging bouts. | ||||||
23 | Promoters of elimination tournaments may request the | ||||||
24 | Department to not accept any participant due to conduct or | ||||||
25 | safety. Upon approval of the request by the Department, the | ||||||
26 | participant in question shall be banned from participating in |
| |||||||
| |||||||
1 | the event. | ||||||
2 | (d) Elimination tournaments shall consist of 3 one-minute | ||||||
3 | rounds with a one-minute rest period between each round. Each | ||||||
4 | round shall be judged on a 10-point must system. | ||||||
5 | Elimination tournaments shall be single-elimination | ||||||
6 | events. An elimination participant who has lost a bout may not | ||||||
7 | participate in the same program of bouts. | ||||||
8 | If a participant is knocked down 3 times in a round, that | ||||||
9 | participant shall be declared the loser of the bout. | ||||||
10 | If a bout is declared a draw, the judges shall reevaluate | ||||||
11 | their scorecards and select a winner. | ||||||
12 | The referee or the ringside physician may stop a bout if, | ||||||
13 | in the judgment of either, allowing the bout to continue may | ||||||
14 | jeopardize the health or the safety of a participant. | ||||||
15 | Elimination tournaments may be one-night or 2-night | ||||||
16 | events. Elimination tournament participants may not | ||||||
17 | participate in more than one match during the first night of a | ||||||
18 | 2-night elimination tournament. | ||||||
19 | An elimination tournament participant may participate in | ||||||
20 | any number of bouts the second night of a 2-night elimination | ||||||
21 | tournament. | ||||||
22 | Competing for or winning a prize in an elimination | ||||||
23 | tournament shall not make the participant a professional within | ||||||
24 | the scope of this Act unless all other participants in the | ||||||
25 | tournament are professionals. | ||||||
26 | Bouts between male and female participants shall not be |
| |||||||
| |||||||
1 | permitted. | ||||||
2 | (e) Participants in elimination tournaments shall: | ||||||
3 | (1) be at least 18 years of age; | ||||||
4 | (2) provide the Department with one form of photo | ||||||
5 | identification with date of birth; | ||||||
6 | (3) complete an application form provided by the | ||||||
7 | Department; | ||||||
8 | (4) submit the required license fee of $20; and | ||||||
9 | (5) provide 2 photographs of himself or herself. | ||||||
10 | An individual may not participate in elimination | ||||||
11 | tournaments if he or she (i) has been a competitor in a | ||||||
12 | professional boxing, kickboxing, or mixed martial arts | ||||||
13 | competition or (ii) has been a winner of more than 5 of any | ||||||
14 | combination of amateur boxing, kickboxing, or elimination | ||||||
15 | tournament events in the past 5 years or more than 3 of any | ||||||
16 | combination of amateur boxing, kickboxing, or elimination | ||||||
17 | tournament events in the past 12 months, unless the event is | ||||||
18 | restricted to winners of previous events. | ||||||
19 | A participant shall not wear any type of body piercing, | ||||||
20 | hard contact lenses, dentures, or removable dental work during | ||||||
21 | a bout. A participant with dental braces may compete if the | ||||||
22 | participant wears a fitted mouthpiece covering the entire | ||||||
23 | brace. | ||||||
24 | Male participants must wear a groin protector and a | ||||||
25 | mouthpiece during all bouts. | ||||||
26 | Female participants shall provide a negative pregnancy |
| |||||||
| |||||||
1 | test that shall be verified by the ringside physician or they | ||||||
2 | shall not be permitted to compete. | ||||||
3 | (f) Each participant shall submit to and complete a | ||||||
4 | pre-bout medical examination performed by a | ||||||
5 | Department-appointed ringside physician before the elimination | ||||||
6 | tournament begins. The physicals shall be performed at the | ||||||
7 | location of the event, unless an alternate location is approved | ||||||
8 | by the Department. The ringside physician shall be a physician | ||||||
9 | licensed to practice medicine in all its branches or doctor of | ||||||
10 | osteopathy. The examination shall cover the following, with the | ||||||
11 | results written on a form provided by the Department: blood | ||||||
12 | pressure, head, eyes, ears, nose, throat, lungs, chest, heart, | ||||||
13 | and abdomen. | ||||||
14 | No participant shall be allowed to participate in an | ||||||
15 | elimination tournament if he or she is under the influence of | ||||||
16 | alcohol or drugs. The Department may require elimination | ||||||
17 | tournament participants to submit to an alcohol breathalyzer | ||||||
18 | test at any time. | ||||||
19 | If the ringside physician determines a participant is unfit | ||||||
20 | to compete for any reason, that participant shall not | ||||||
21 | participate in the elimination tournament. The ringside | ||||||
22 | physician shall remain at ringside at all times during an | ||||||
23 | elimination tournament bout and shall perform post-bout | ||||||
24 | medical evaluations of all participants. The Department shall | ||||||
25 | provide forms for the ringside physician to complete. | ||||||
26 | (g) The promoter shall provide all of the following |
| |||||||
| |||||||
1 | ringside at the elimination tournament: | ||||||
2 | (1) a sufficient number of buckets for use by the | ||||||
3 | participants; | ||||||
4 | (2) stools for use by seconds; | ||||||
5 | (3) rubber gloves for use by the referees, seconds, | ||||||
6 | ringside physicians, and inspectors; | ||||||
7 | (4) seats at ringside for the assigned officials, | ||||||
8 | including a seat near the steps into the ring for the | ||||||
9 | physician; | ||||||
10 | (5) scales for weigh-ins, which the Department may | ||||||
11 | require to be certified; | ||||||
12 | (6) a bell; | ||||||
13 | (7) a public address system; | ||||||
14 | (8) a separate dressing room for both genders, if | ||||||
15 | participants of each gender are participating; | ||||||
16 | (9) a separate room for physical examinations; and | ||||||
17 | (10) a separate dressing room for officials, unless the | ||||||
18 | physical arrangements of the contest site make an | ||||||
19 | additional dressing room impossible. | ||||||
20 | (h) Elimination tournaments shall consist of the following | ||||||
21 | 4 weight classes for male and female participants: | ||||||
22 | (1) The lightweight class shall consist of | ||||||
23 | participants of at least 140 but less that 160 pounds in | ||||||
24 | weight. | ||||||
25 | (2) The light heavyweight class shall consist of | ||||||
26 | participants of at least 160 but less that 185 pounds in |
| |||||||
| |||||||
1 | weight. | ||||||
2 | (3) The heavyweight class shall consist of | ||||||
3 | participants of at least 185 but less that 205 pounds in | ||||||
4 | weight. | ||||||
5 | (3) The super heavyweight class shall consist of | ||||||
6 | participants of at least 205 pounds in weight. | ||||||
7 | The promoter may add additional weight classes to the | ||||||
8 | program of bouts if participants in other categories apply to | ||||||
9 | compete upon approval by the Department.
| ||||||
10 | Section 99. Effective date. This Act takes effect upon | ||||||
11 | becoming law.".
