1 | AMENDMENT TO HOUSE BILL 1791
| ||||||
2 | AMENDMENT NO. ______. Amend House Bill 1791 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The School Code is amended by changing Section | ||||||
5 | 13A-8 as follows:
| ||||||
6 | (105 ILCS 5/13A-8)
| ||||||
7 | Sec. 13A-8. Funding.
| ||||||
8 | (a) The State of Illinois shall provide funding for
the
| ||||||
9 | alternative school programs within each educational service | ||||||
10 | region and within
the Chicago public school system by line item | ||||||
11 | appropriation made to the State
Board of Education for that | ||||||
12 | purpose. This money, when appropriated, shall be
provided to | ||||||
13 | the regional superintendent and to the Chicago Board of | ||||||
14 | Education,
who shall establish a budget, including salaries, | ||||||
15 | for their
alternative school programs.
Each program shall | ||||||
16 | receive funding in the amount of $30,000 plus an amount
based |

| |||||||
1 | on the ratio of the region's or Chicago's last best 3 years' | ||||||
2 | months' average daily
attendance in grades pre-kindergarten | ||||||
3 | through 12 of pupils served by the alternative school program | ||||||
4 | to the statewide totals of
these amounts. For purposes of this | ||||||
5 | calculation, the best 3 months' average
daily attendance for | ||||||
6 | each region or Chicago shall be calculated by adding to
the | ||||||
7 | best 3 months' average
daily
attendance the number of | ||||||
8 | low-income students identified in the most
recently available | ||||||
9 | federal census multiplied by one-half times the percentage
of | ||||||
10 | the
region's or Chicago's low-income students
to the State's | ||||||
11 | total low-income students.
The State Board of Education shall | ||||||
12 | retain
up to 1.1% of the appropriation to be used to provide | ||||||
13 | technical assistance,
professional development, and | ||||||
14 | evaluations for the programs.
| ||||||
15 | (a-5) Notwithstanding any other provisions of this | ||||||
16 | Section, for the
1998-1999
fiscal year, the total amount | ||||||
17 | distributed
under subsection (a) for an alternative school | ||||||
18 | program shall be not less than
the total amount that was | ||||||
19 | distributed under that subsection for that
alternative school | ||||||
20 | program for the 1997-1998 fiscal year. If an alternative
school | ||||||
21 | program is to receive a total distribution under subsection (a) | ||||||
22 | for the
1998-1999 fiscal year that is less than the total
| ||||||
23 | distribution that the program received under that subsection | ||||||
24 | for the 1997-1998
fiscal year, that alternative school program | ||||||
25 | shall also receive, from a
separate appropriation made for | ||||||
26 | purposes of this subsection (a-5), a
supplementary
payment |

1 | equal to the amount by which its total distribution under
| ||||||
2 | subsection (a) for the 1997-1998 fiscal year exceeds the amount | ||||||
3 | of the total
distribution that the alternative school program | ||||||
4 | receives under that
subsection for the 1998-1999 fiscal year.
| ||||||
5 | If the amount appropriated
for supplementary payments to | ||||||
6 | alternative school programs under this subsection
(a-5)
is | ||||||
7 | insufficient for that purpose, those supplementary payments | ||||||
8 | shall be
prorated among the alternative school programs | ||||||
9 | entitled to receive those
supplementary payments according to | ||||||
10 | the aggregate amount of the appropriation
made for purposes of | ||||||
11 | this subsection (a-5).
| ||||||
12 | (b) An alternative school program shall be entitled to | ||||||
13 | receive general
State aid as calculated in subsection (K) of
| ||||||
14 | Section 18-8.05 upon filing a claim as
provided therein. Any | ||||||
15 | time that a student who is enrolled in an alternative
school | ||||||
16 | program spends in work-based learning, community service, or a | ||||||
17 | similar
alternative educational setting shall be included in | ||||||
18 | determining the student's
minimum number of clock hours of | ||||||
19 | daily school work that constitute a day of
attendance for | ||||||
20 | purposes of calculating general State aid.
| ||||||
21 | (c) An alternative school program may receive additional | ||||||
22 | funding from its
school districts in such amount as may be | ||||||
23 | agreed upon by the parties and
necessary
to support the | ||||||
24 | program. In addition, an alternative school program is
| ||||||
25 | authorized to accept and expend gifts, legacies, and grants, | ||||||
26 | including but not
limited to federal grants, from any source |

| |||||||
1 | for purposes directly related to the
conduct and operation of | ||||||
2 | the program.
