AMENDMENT TO HOUSE BILL 2146
AMENDMENT NO. ______. Amend House Bill 2146 by replacing
everything after the enacting clause with the following:
"Section 5. The Children and Family Services Act is
amended by adding Section 4g as follows:
(20 ILCS 505/4g new)
Sec. 4g. Indemnification prohibited. In any purchase of
service contract or other agreement between the Department and
any public or private agency for services consistent with this
Act, the Department shall not include any term or provision
that seeks to impose or imposes on the agency an obligation to
indemnify, hold harmless, or insure the Department and any of
its agents from any liability, loss, damage, claim, cost, or
expense, including attorney's fees. The Department's inclusion
of any term or provision that imposes or seeks to impose
indemnity on any agency is void and unenforceable as against

public policy.".
