1 | AMENDMENT TO HOUSE BILL 2372

2 | AMENDMENT NO. ______. Amend House Bill 2372 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The State Fire Marshal Act is amended by | ||||||
5 | adding Section 5 as follows:
| ||||||
6 | (20 ILCS 2905/5 new) | ||||||
7 | Sec. 5. Youth Firesetter Interventionist Coordinator; | ||||||
8 | certified youth firesetter interventionists. | ||||||
9 | (a) The Office of the State Fire Marshal shall create the | ||||||
10 | position of Youth Firesetter Interventionist Coordinator | ||||||
11 | within the Division of Arson and shall employ a person to serve | ||||||
12 | in that position. An applicant to the position of Youth | ||||||
13 | Firesetter Interventionist Coordinator must be a certified | ||||||
14 | youth firesetter interventionist coordinator based on the | ||||||
15 | standards set forth in Chapter 9 of the National Fire | ||||||
16 | Protection Association's "Standard on Fire and Life Safety |

1 | Education, Public Information Officer, Youth Firesetter | ||||||
2 | Intervention Specialist and Youth Firesetting Program Manager | ||||||
3 | Professional Qualifications" (NFPA 1035). | ||||||
4 | (b) The Youth Firesetter Interventionist Coordinator | ||||||
5 | employed by the Office shall be compensated at a rate that is | ||||||
6 | comparable to the rate of compensation for a State arson | ||||||
7 | investigator and shall be provided benefits similar to those | ||||||
8 | of a State arson investigator. The Youth Firesetter | ||||||
9 | Interventionist Coordinator shall also be provided similar | ||||||
10 | means and resources as those supplied to a State arson | ||||||
11 | investigator. | ||||||
12 | (c) The Youth Firesetter Interventionist Coordinator shall | ||||||
13 | have those responsibilities that are stipulated for a Youth | ||||||
14 | Firesetter Program Manager in Chapter 9 of NFPA 1035. In | ||||||
15 | addition to those requirements, the Youth Firesetter | ||||||
16 | Interventionist Coordinator shall have the following | ||||||
17 | responsibilities: | ||||||
18 | (1) The Youth Firesetter Interventionist Coordinator | ||||||
19 | shall ensure that a certified youth firesetter | ||||||
20 | interventionist employed within the Office, or a volunteer | ||||||
21 | certified youth firesetter interventionist, physically | ||||||
22 | sees a child whose case was referred to the coordinator | ||||||
23 | within 72 hours of the referral. If no certified youth | ||||||
24 | firesetter interventionist is available, then the Youth | ||||||
25 | Firesetter Interventionist Coordinator must take the case | ||||||
26 | and ensure the child is seen within 72 hours. The 72-hour |

1 | requirement begins and continues from the time the
Youth | ||||||
2 | Firesetter Interventionist Coordinator is referred the | ||||||
3 | case, including any weekend days or national and State | ||||||
4 | holidays. | ||||||
5 | (2) The Youth Firesetter Interventionist Coordinator | ||||||
6 | shall process Freedom of Information Act requests. | ||||||
7 | (3) The Youth Firesetter Interventionist Coordinator | ||||||
8 | shall create a report, to be submitted to the General | ||||||
9 | Assembly, that reports on the data collected in accordance | ||||||
10 | with NFPA 1035. The report shall be semiannual for the | ||||||
11 | first 2 years, and the first report shall be submitted to | ||||||
12 | the General Assembly by December 30, 2023. After the first | ||||||
13 | 2 years of semiannual reporting, the report shall be | ||||||
14 | submitted annually. | ||||||
15 | (d) A volunteer certified youth firesetter interventionist | ||||||
16 | may receive a $250 stipend for a case only if the volunteer | ||||||
17 | certified youth firesetter interventionist is not otherwise | ||||||
18 | compensated by another employer or entity for that case. A | ||||||
19 | volunteer certified youth firesetter interventionist shall | ||||||
20 | receive mileage reimbursement for any necessary travel.

21 | Section 99. Effective date. This Act takes effect upon | ||||||
22 | becoming law.".
