2 | AMENDMENT NO. ______. Amend House Bill 3121 on page 3, by | ||||||
3 | replacing lines 4 through 25 with the following:
| ||||||
4 | "The furnishing of financial information to a municipality | ||||||
5 | or county , upon request of the chief executive officer Chief
| ||||||
6 | Executive thereof, is an official purpose within the meaning of | ||||||
7 | this Section,
provided the municipality or county agrees in
| ||||||
8 | writing to the requirements of this Section. Information | ||||||
9 | provided to municipalities or counties under this paragraph | ||||||
10 | shall be limited to: (1) the business name; (2) the business | ||||||
11 | address; (3) the standard classification number assigned to the | ||||||
12 | business; (4) net revenue distributed to the requesting | ||||||
13 | municipality or county that is directly related to the | ||||||
14 | requesting municipality's or county's local share of the | ||||||
15 | proceeds under the Use Tax Act, the Service Use Tax Act, the | ||||||
16 | Service Occupation Tax Act, and the Retailers' Occupation Tax | ||||||
17 | Act, and, if applicable, any locally imposed retailers' | ||||||
18 | occupation tax or service occupation tax; and (5) (4) a listing |

1 | of all businesses within the requesting municipality or county | ||||||
2 | by account identification number and address. On and after July | ||||||
3 | 1, 2015, the furnishing of financial information to | ||||||
4 | municipalities or counties under this paragraph may be by | ||||||
5 | electronic means.

6 | Information so provided shall be subject to all | ||||||
7 | confidentiality provisions
of this Section. The written | ||||||
8 | agreement shall provide for reciprocity,
limitations on | ||||||
9 | access, disclosure, and procedures for requesting information. | ||||||
10 | Only the chief executive officer of the municipality or county | ||||||
11 | may initiate the written agreement with the Department. The | ||||||
12 | chief executive officer of the municipality or county shall | ||||||
13 | provide the Department with a list of names and official titles | ||||||
14 | of municipal or county personnel, as appropriate, designated by | ||||||
15 | the chief executive officer as persons exclusively authorized | ||||||
16 | to request return information, view return information, or | ||||||
17 | receive related information on his or her behalf. This list | ||||||
18 | shall be restricted to municipal or county personnel, as | ||||||
19 | appropriate, who are directly involved in the financial | ||||||
20 | operations of the municipality or county, and the financial | ||||||
21 | information provided by the Department shall not be viewed by | ||||||
22 | or shared with anyone who is not on the list. The written | ||||||
23 | agreement may be canceled by either the Department or the chief | ||||||
24 | executive officer of the municipality or county at any time and | ||||||
25 | shall be canceled in the event of any unauthorized use or | ||||||
26 | disclosure of State tax return information obtained pursuant to |

1 | the written agreement, or in the event of a failure to abide by | ||||||
2 | the procedures set forth in the agreement by the Department for | ||||||
3 | safeguarding the confidentiality of such return information. ".
