1 | AMENDMENT TO HOUSE BILL 4472

2 | AMENDMENT NO. ______. Amend House Bill 4472 as follows:
| ||||||
3 | on page 1, line 5, by replacing "Section" with "Sections 9-158 | ||||||
4 | and"; and
| ||||||
5 | on page 1, immediately below line 5, by inserting the | ||||||
6 | following:
| ||||||
7 | "(40 ILCS 5/9-158) (from Ch. 108 1/2, par. 9-158)
| ||||||
8 | Sec. 9-158. Proof of disability, duty and ordinary. Proof | ||||||
9 | of duty or ordinary disability shall be furnished to the board | ||||||
10 | by
at least one licensed and practicing physician appointed by | ||||||
11 | or acceptable to the board, except that this requirement may be | ||||||
12 | waived by the board for proof of duty disability if the | ||||||
13 | employee has been compensated by the county for such disability | ||||||
14 | or specific loss under the Workers' Compensation Act or | ||||||
15 | Workers' Occupational Diseases Act. The physician requirement |

1 | may also be waived by the board for ordinary disability | ||||||
2 | maternity claims of up to 8 weeks. With respect to duty | ||||||
3 | disability, satisfactory proof must be provided to the board | ||||||
4 | that the final adjudication of the claim required under | ||||||
5 | subsection (d) of Section 9-159 established that the disability | ||||||
6 | or death resulted from an injury incurred in the performance of | ||||||
7 | an act or acts of duty. The
board may require other evidence of | ||||||
8 | disability. Each disabled employee who
receives duty or | ||||||
9 | ordinary disability benefit shall be examined at least
once a | ||||||
10 | year or a longer period of time as determined by the board, by | ||||||
11 | one or more licensed and practicing physicians appointed by
the | ||||||
12 | board. When the disability ceases, the board shall discontinue | ||||||
13 | payment
of the benefit.
