2 | AMENDMENT NO. ______. Amend Senate Bill 624 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Illinois Highway Code is amended by | ||||||
5 | changing Section 9-131 as follows:

6 | (605 ILCS 5/9-131)
| ||||||
7 | Sec. 9-131. Installation of fiber-optic network conduit. | ||||||
8 | (a) For purposes of this Section: | ||||||
9 | "Fiber-optic network conduit" means a pipe or duct used to | ||||||
10 | enclose fiber-optic cable facilities buried alongside the | ||||||
11 | roadway or surface mounted on bridges, overpasses, and other | ||||||
12 | facilities where below ground placement is impossible or | ||||||
13 | impractical. | ||||||
14 | (b) In order to ensure affordable high-speed, world-class | ||||||
15 | core information and communication networks are available | ||||||
16 | throughout Illinois, the Illinois Department of Transportation |

1 | and the Department of Central Management Services shall | ||||||
2 | collaborate to install fiber-optic network conduit where it | ||||||
3 | does not already exist in every new State-funded construction | ||||||
4 | project that opens, bores, or trenches alongside a State-owned | ||||||
5 | infrastructure, including, but not limited to, roadways and | ||||||
6 | bridges. The Department of Central Management Services or the | ||||||
7 | Department of Transportation may permit a third party to manage | ||||||
8 | the fiber and conduit leasing. Counties with a population of | ||||||
9 | more than 3,000,000 inhabitants shall be notified of | ||||||
10 | fiber-optic network conduit installations made under this | ||||||
11 | Section and shall have the right to install fiber-optic network | ||||||
12 | conduit during State-funded construction projects. The | ||||||
13 | Department of Central Management Services and the Department of | ||||||
14 | Transportation shall take reasonable steps to ensure | ||||||
15 | market-based, non-discriminatory pricing. Public bidding | ||||||
16 | notices for such projects must describe the need for | ||||||
17 | fiber-optic conduit or cable. The Department of Transportation | ||||||
18 | shall report annually to the Governor and the General Assembly | ||||||
19 | on the progress and any associated costs incurred by this | ||||||
20 | Section. This Section does not prohibit the State from | ||||||
21 | purchasing or installing fiber-optic cable within the | ||||||
22 | fiber-optic network conduit.
