1 | AMENDMENT TO SENATE BILL 1176 | ||||||
2 | AMENDMENT NO. ______. Amend Senate Bill 1176 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Department of Central Management Services | ||||||
5 | Law of the Civil Administrative Code of Illinois is amended by | ||||||
6 | adding Section 405-545 as follows:
| ||||||
7 | (20 ILCS 405/405-545 new) | ||||||
8 | Sec. 405-545. State Retiree Medicare Primacy Coordination | ||||||
9 | Audit and Assistance Program. | ||||||
10 | (a) Within 6 months after the effective date of this | ||||||
11 | amendatory Act of the 103rd General Assembly, the Department | ||||||
12 | of Central Management Services, in conjunction with the State | ||||||
13 | Employees Retirement System, the State Universities Retirement | ||||||
14 | System, the Teachers' Retirement System, the Judges' | ||||||
15 | Retirement System, and the General Assembly Retirement System, | ||||||
16 | may enter into a contract with a qualified and experienced |

1 | administrator to establish and conduct a State Retiree | ||||||
2 | Medicare Primacy Coordination Audit and Assistance Program to | ||||||
3 | identify annuitants, retirees, benefit recipients, survivors | ||||||
4 | or their dependents who are eligible for Medicare, but not | ||||||
5 | enrolled in Medicare, and to assist those annuitants, | ||||||
6 | retirees, benefit recipients, survivors or their dependents | ||||||
7 | with enrolling in Social Security and Medicare. | ||||||
8 | (b) The State Retiree Medicare Primacy Coordination Audit | ||||||
9 | and Assistance Program shall conduct an annual audit of the | ||||||
10 | State Health Benefits Program for everyone covered under the | ||||||
11 | State Employee Group Health Plan, the Teachers' Retirement | ||||||
12 | Insurance Program, and the Community College Insurance Program | ||||||
13 | for the purpose of identifying participants and their | ||||||
14 | dependents who are eligible for Medicare under federal law. | ||||||
15 | The Program shall also ensure that those annuitants, retirees, | ||||||
16 | benefit recipients, survivors or their dependents who are | ||||||
17 | eligible for Medicare are enrolled in Medicare with Medicare | ||||||
18 | as their primary health care benefits coverage and the State | ||||||
19 | Health Benefits Program being the secondary provider of their | ||||||
20 | health care benefits coverage. | ||||||
21 | (c) The State Retiree Medicare Primacy Coordination Audit | ||||||
22 | and Assistance Program shall assist any annuitant, retiree, | ||||||
23 | benefit recipient, survivor or their dependents who becomes | ||||||
24 | disabled, and is not enrolled in Social Security Disability | ||||||
25 | Insurance and Medicare, with enrolling in and obtaining Social | ||||||
26 | Security Disability Insurance and Medicare benefits. This |

1 | assistance shall include, but not be limited to: (i) | ||||||
2 | developing communication materials to educate individuals | ||||||
3 | about Social Security Disability Insurance benefits; (ii) | ||||||
4 | performing multiple outreaches to targeted populations; (iii) | ||||||
5 | analyzing responses to determine Social Security Disability | ||||||
6 | Insurance eligibility; and (iv) representing qualified | ||||||
7 | individuals on their claim for Social Security Disability | ||||||
8 | Insurance and Medicare. | ||||||
9 | (d) The administrator shall provide the Department, the | ||||||
10 | State Employees Retirement System, and the General Assembly | ||||||
11 | with an annual report showing the number of annuitants, | ||||||
12 | retirees, benefit recipients, survivors and dependents who are | ||||||
13 | transitioned to Social Security Disability Insurance and | ||||||
14 | Medicare and the amount of savings realized by the State of | ||||||
15 | Illinois.
