AMENDMENT TO SENATE BILL 1176
2 AMENDMENT NO. ______. Amend Senate Bill 1176 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-545 as follows:
7 (20 ILCS 405/405-545 new)
8 Sec. 405-545. State Retiree Medicare Primacy Coordination
9Audit and Assistance Program.
10 (a) Within 6 months after the effective date of this
11amendatory Act of the 103rd General Assembly, the Department
12of Central Management Services, in conjunction with the State
13Employees Retirement System, the State Universities Retirement
14System, the Teachers' Retirement System, the Judges'
15Retirement System, and the General Assembly Retirement System,
16may enter into a contract with a qualified and experienced

1administrator to establish and conduct a State Retiree
2Medicare Primacy Coordination Audit and Assistance Program to
3identify annuitants, retirees, benefit recipients, survivors
4or their dependents who are eligible for Medicare, but not
5enrolled in Medicare, and to assist those annuitants,
6retirees, benefit recipients, survivors or their dependents
7with enrolling in Social Security and Medicare.
8 (b) The State Retiree Medicare Primacy Coordination Audit
9and Assistance Program shall conduct an annual audit of the
10State Health Benefits Program for everyone covered under the
11State Employee Group Health Plan, the Teachers' Retirement
12Insurance Program, and the Community College Insurance Program
13for the purpose of identifying participants and their
14dependents who are eligible for Medicare under federal law.
15The Program shall also ensure that those annuitants, retirees,
16benefit recipients, survivors or their dependents who are
17eligible for Medicare are enrolled in Medicare with Medicare
18as their primary health care benefits coverage and the State
19Health Benefits Program being the secondary provider of their
20health care benefits coverage.
21 (c) The State Retiree Medicare Primacy Coordination Audit
22and Assistance Program shall assist any annuitant, retiree,
23benefit recipient, survivor or their dependents who becomes
24disabled, and is not enrolled in Social Security Disability
25Insurance and Medicare, with enrolling in and obtaining Social
26Security Disability Insurance and Medicare benefits. This

1assistance shall include, but not be limited to: (i)
2developing communication materials to educate individuals
3about Social Security Disability Insurance benefits; (ii)
4performing multiple outreaches to targeted populations; (iii)
5analyzing responses to determine Social Security Disability
6Insurance eligibility; and (iv) representing qualified
7individuals on their claim for Social Security Disability
8Insurance and Medicare.
9 (d) The administrator shall provide the Department, the
10State Employees Retirement System, and the General Assembly
11with an annual report showing the number of annuitants,
12retirees, benefit recipients, survivors and dependents who are
13transitioned to Social Security Disability Insurance and
14Medicare and the amount of savings realized by the State of
15Illinois.
