1 | AMENDMENT TO SENATE BILL 1250
| ||||||
2 | AMENDMENT NO. ______. Amend Senate Bill 1250 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 1. Short title. This Act may be cited as the | ||||||
5 | Sprayed Fire-Resistant Material Applicator Act.
| ||||||
6 | Section 5. Definitions. As used in this Act: | ||||||
7 | "Office" means the Office of the State Fire Marshal. | ||||||
8 | "Sprayed fire-resistant material" means a cementitious or | ||||||
9 | fibrous material that is applied onto a steel structure | ||||||
10 | through a spray process to provide fire-resistant protection | ||||||
11 | to the steel structure. | ||||||
12 | "Sprayed fire-resistant material applicator" means an | ||||||
13 | individual in the business of applying sprayed fire-resistant | ||||||
14 | material.

15 | Section 10. Fire-resistant material applicator |

1 | registration. | ||||||
2 | (a) Beginning July 1, 2026, it is unlawful for a person to | ||||||
3 | engage in business as a sprayed fire-resistant material | ||||||
4 | applicator in this State without being registered with the | ||||||
5 | Office as provided in this Act. A person who violates this | ||||||
6 | Section may be assessed a civil penalty by the Office of up to | ||||||
7 | $250 for each violation. Each day's violation constitutes a | ||||||
8 | separate offense. The Attorney General or the State's Attorney | ||||||
9 | of the county in which the violation occurs may bring an action | ||||||
10 | in the name of the People of the State of Illinois or may, in | ||||||
11 | addition to other remedies provided in this Act, bring an | ||||||
12 | action for an injunction to restrain a violation of this | ||||||
13 | subsection. | ||||||
14 | (b) The Office shall: | ||||||
15 | (1) register persons as sprayed fire-resistant | ||||||
16 | material applicators; and | ||||||
17 | (2) establish requirements for the registration of | ||||||
18 | sprayed fire-resistant material applicators that includes | ||||||
19 | a requirement for proof of training or certification. | ||||||
20 | (c) A person seeking registration as a sprayed | ||||||
21 | fire-resistant material applicator shall meet the requirements | ||||||
22 | established by the Office to register as a sprayed | ||||||
23 | fire-resistant material applicator. | ||||||
24 | (d) Registration as a sprayed fire-resistant material | ||||||
25 | applicator must be renewed every 3 years.

1 | Section 15. Rules and fees. | ||||||
2 | (a) By July 1, 2025, the Office shall adopt rules | ||||||
3 | consistent with the provisions of this Act for the | ||||||
4 | administration and enforcement of this Act. The Office may | ||||||
5 | prescribe forms to be issued in connection with the | ||||||
6 | administration and enforcement of this Act. | ||||||
7 | (b) The Office may, by rule, establish fees, including, | ||||||
8 | but not limited to, registration fees and processing fees. All | ||||||
9 | fees collected pursuant to this Act shall be deposited into | ||||||
10 | the Fire Prevention Fund. All fees paid pursuant to this Act | ||||||
11 | are nonrefundable. This shall not preclude the Office from | ||||||
12 | refunding accidental overpayment of fees.

13 | Section 20. Exemptions. This Act does not apply to sprayed | ||||||
14 | fire-resistant material applicators at facilities licensed by | ||||||
15 | the federal Nuclear Regulatory Commission under 10 CFR 50 or | ||||||
16 | 10 CFR 52 or to employees of those facilities while engaged in | ||||||
17 | the performance of their official duties.

18 | Section 99. Effective date. This Act takes effect upon | ||||||
19 | becoming law.".
