| ||||||
2 | AMENDMENT NO. ______. Amend Senate Bill 1595 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 1. Short title. This Act may be cited as the Music | ||||||
5 | Therapy Advisory Board Act.
| ||||||
6 | Section 5. Definitions. As used in this Act: | ||||||
7 | "Board" means the Music Therapy Advisory Board. | ||||||
8 | "Music therapist" means a person who is certified by the | ||||||
9 | Certification Board for Music Therapists. | ||||||
10 | "Music therapy" means the clinical and evidence-based use | ||||||
11 | of music interventions to accomplish individualized goals for | ||||||
12 | people of all ages and ability levels within a therapeutic | ||||||
13 | relationship by a credentialed professional who has completed | ||||||
14 | an approved music therapy program. The music therapy | ||||||
15 | interventions may include music improvisation, receptive music | ||||||
16 | listening, song writing, lyric discussion, music and imagery, |

1 | singing, music performance, learning through music, music | ||||||
2 | combined with other arts, music-assisted relaxation, | ||||||
3 | music-based patient education, electronic music technology, | ||||||
4 | adapted music intervention, and movement to music. The term | ||||||
5 | "music therapy" does not include the diagnosis or assessment of | ||||||
6 | any physical, mental, or communication disorder. | ||||||
7 | "Department" means the Department of Financial and | ||||||
8 | Professional Regulation. | ||||||
9 | "Secretary" means the Secretary of Financial and | ||||||
10 | Professional Regulation or his or her designee.

11 | Section 10. Advisory board. | ||||||
12 | (a) There is created the Music Therapy Advisory Board | ||||||
13 | within the Department. The Board shall consist of 7 members | ||||||
14 | appointed by the Secretary for a term of 2 years. The Secretary | ||||||
15 | shall make the appointments to the Board within 90 days after | ||||||
16 | the effective date of this Act. The members of the Board shall | ||||||
17 | represent different racial and ethnic backgrounds, reasonably | ||||||
18 | reflect the different geographic areas in Illinois, and have | ||||||
19 | the qualifications as follows: | ||||||
20 | (1) three members who currently serve as music | ||||||
21 | therapists in Illinois; | ||||||
22 | (2) one member who represents the Department; | ||||||
23 | (3) one member who is a licensed psychologist or | ||||||
24 | professional counselor in Illinois; | ||||||
25 | (4) one member who is a licensed social worker in |

1 | Illinois; and | ||||||
2 | (5) one representative of a community college, | ||||||
3 | university, or educational institution that provides | ||||||
4 | training to music therapists.
| ||||||
5 | (b) The members of the Board shall select a chairperson | ||||||
6 | from the members of the Board. The Board shall consult with | ||||||
7 | additional experts as needed. Four members constitute a quorum. | ||||||
8 | The Board shall hold its first meeting within 30 days after the | ||||||
9 | appointment of members by the Secretary. Members of the Board | ||||||
10 | shall serve without compensation. The Department shall provide | ||||||
11 | administrative and staff support to the Board. The meetings of | ||||||
12 | the Board are subject to the provisions of the Open Meetings | ||||||
13 | Act. | ||||||
14 | (c) The Board shall consider the core competencies of a | ||||||
15 | music therapist, including skills and areas of knowledge that | ||||||
16 | are essential to bringing about music therapy services to | ||||||
17 | communities by qualified individuals. As relating to music | ||||||
18 | therapy services, the core competencies for effective music | ||||||
19 | therapists may include, but are not limited to:
| ||||||
20 | (1) materials to educate the public concerning music | ||||||
21 | therapist licensure; | ||||||
22 | (2) the benefits of music therapy; | ||||||
23 | (3) the utilization of music therapy by individuals and | ||||||
24 | in facilities or institutional settings; | ||||||
25 | (4) culturally competent communication and care; | ||||||
26 | (5) music therapy for behavior change; |

1 | (6) support from the American Music Therapy | ||||||
2 | Association or any successor organization and the | ||||||
3 | Certification Board for Music Therapists; | ||||||
4 | (7) clinical training; and | ||||||
5 | (8) education and continuing education requirements.
| ||||||
6 | Section 15. Report. | ||||||
7 | (a) The Board shall develop a report with its | ||||||
8 | recommendations regarding the certification process for music | ||||||
9 | therapists. The report shall be completed no later than 12 | ||||||
10 | months after the first meeting of the Board. The report shall | ||||||
11 | be submitted to all members of the Board, the Secretary, the | ||||||
12 | Governor, the President of the Senate, the Minority Leader of | ||||||
13 | the Senate, the Speaker of the House of Representatives, and | ||||||
14 | the Minority Leader of the House of Representatives. The | ||||||
15 | Department shall publish the report on its Internet website. | ||||||
16 | (b) The report shall at a minimum include the following: | ||||||
17 | (1) a summary of research regarding the best practices, | ||||||
18 | curriculum, and training programs for designing a | ||||||
19 | certification program in this State for music therapists, | ||||||
20 | including a consideration of a multi-tiered education or | ||||||
21 | training system, statewide certification, | ||||||
22 | non-certification degree-based levels of certification, | ||||||
23 | support from the American Music Therapy Association and | ||||||
24 | Certification Board for Music Therapists, and the | ||||||
25 | requirements for experience-based certification; |

1 | (2) recommendations regarding certification and | ||||||
2 | renewal process for music therapists and a system of | ||||||
3 | approval and accreditation for curriculum and training; | ||||||
4 | (3) recommendations for a proposed curriculum for | ||||||
5 | music therapists that ensures the content, methodology, | ||||||
6 | development, and delivery of any proposed program is | ||||||
7 | appropriately based on cultural, geographic, and other | ||||||
8 | specialty needs and also reflects relevant | ||||||
9 | responsibilities for music therapists; and | ||||||
10 | (4) recommendations for best practices for | ||||||
11 | reimbursement options and pathways through which secure | ||||||
12 | funding for music therapists may be obtained. | ||||||
13 | (c) The Board shall advise the Department, the Governor, | ||||||
14 | and the General Assembly on all matters that impact the | ||||||
15 | effective work of music therapists.".
