1 | AMENDMENT TO SENATE BILL 1993

2 | AMENDMENT NO. ______. Amend Senate Bill 1993 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The School Code is amended by adding Sections | ||||||
5 | 10-20.85 and 34-18.82 as follows:

6 | (105 ILCS 5/10-20.85 new) | ||||||
7 | Sec. 10-20.85. Community input on local assessments. | ||||||
8 | (a) As used in this Section, "district-administered | ||||||
9 | assessment" means an assessment that requires all student test | ||||||
10 | takers at any grade level to answer the same questions, or a | ||||||
11 | selection of questions from a common bank of questions, in the | ||||||
12 | same manner or substantially the same questions in the same | ||||||
13 | manner. The term does not include an observational assessment | ||||||
14 | tool used to satisfy the requirements of Section 2-3.64a-10 of | ||||||
15 | this Code or an assessment developed by district teachers or | ||||||
16 | administrators that will be used to measure student progress |

1 | at an attendance center within the school district. | ||||||
2 | (b) Prior to approving a new contract for any | ||||||
3 | district-administered assessment, a school board must hold a | ||||||
4 | public vote at a regular meeting of the school board, at which | ||||||
5 | the terms of the proposal must be substantially presented and | ||||||
6 | an opportunity for allowing public comments must be provided, | ||||||
7 | subject to applicable notice requirements. However, if the | ||||||
8 | assessment being made available to review is subject to | ||||||
9 | copyright, trademark, or other intellectual property | ||||||
10 | protection, the review process shall include technical and | ||||||
11 | procedural safeguards to ensure that the materials are not | ||||||
12 | able to be widely disseminated to the general public in | ||||||
13 | violation of the intellectual property rights of the publisher | ||||||
14 | and to ensure content validity is not undermined.
