1 | AMENDMENT TO SENATE BILL 3335
| ||||||
2 | AMENDMENT NO. ______. Amend Senate Bill 3335 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Emergency Medical Services (EMS) Systems | ||||||
5 | Act is amended by changing Section 3.55 as follows:
| ||||||
6 | (210 ILCS 50/3.55)
| ||||||
7 | Sec. 3.55. Scope of practice.
| ||||||
8 | (a) Any person currently licensed as an EMR, EMT, EMT-I,
| ||||||
9 | A-EMT, or Paramedic may perform emergency and non-emergency | ||||||
10 | medical
services as defined in this Act, in accordance with his | ||||||
11 | or her level of
education, training and licensure, the | ||||||
12 | standards of
performance and conduct prescribed by the | ||||||
13 | Department in
rules adopted pursuant to this Act, and the | ||||||
14 | requirements of
the EMS System in which he or she practices, as | ||||||
15 | contained in the
approved Program Plan for that System. The | ||||||
16 | Director may, by written order, temporarily modify individual |

1 | scopes of practice in response to public health emergencies for | ||||||
2 | periods not exceeding 180 days.
| ||||||
3 | (a-5) EMS personnel who have successfully completed a | ||||||
4 | Department approved
course in automated defibrillator | ||||||
5 | operation and who are functioning within a
Department approved | ||||||
6 | EMS System may utilize such automated defibrillator
according | ||||||
7 | to the standards of performance and conduct prescribed by the
| ||||||
8 | Department
in rules adopted pursuant to this Act and the | ||||||
9 | requirements of the EMS System in
which they practice, as | ||||||
10 | contained in the approved Program Plan for that
System.
| ||||||
11 | (a-7) An EMT, EMT-I, A-EMT, or Paramedic
who has | ||||||
12 | successfully completed a Department approved course in the
| ||||||
13 | administration of epinephrine shall be required to carry | ||||||
14 | epinephrine
with him or her as part of the EMS personnel | ||||||
15 | medical supplies whenever
he or she is performing official | ||||||
16 | duties as determined by the EMS System. The epinephrine may be | ||||||
17 | administered from a glass vial, auto-injector, ampule, or | ||||||
18 | pre-filled syringe.
| ||||||
19 | (b) An EMR, EMT,
EMT-I, A-EMT, or Paramedic may practice as | ||||||
20 | an EMR, EMT, EMT-I, A-EMT, or Paramedic or utilize his or her | ||||||
21 | EMR, EMT, EMT-I, A-EMT, or Paramedic license
in pre-hospital or | ||||||
22 | inter-hospital emergency care settings or
non-emergency | ||||||
23 | medical transport situations, under the
written or verbal | ||||||
24 | direction of the EMS Medical Director.
For purposes of this | ||||||
25 | Section, a "pre-hospital emergency care
setting" may include a | ||||||
26 | location, that is not a health care
facility, which utilizes |

| |||||||
1 | EMS personnel to render pre-hospital
emergency care prior to | ||||||
2 | the arrival of a transport vehicle.
The location shall include | ||||||
3 | communication equipment and all
of the portable equipment and | ||||||
4 | drugs appropriate for the EMR, EMT, EMT-I, A-EMT, or | ||||||
5 | Paramedic's
level of care, as required by this Act, rules | ||||||
6 | adopted
by the Department pursuant to this Act, and the | ||||||
7 | protocols of
the EMS Systems, and shall operate only with the | ||||||
8 | approval
and under the direction of the EMS Medical Director.
| ||||||
9 | This Section shall not prohibit an EMR, EMT, EMT-I, A-EMT, | ||||||
10 | or Paramedic
from practicing within an emergency department or
| ||||||
11 | other health care setting for the purpose of receiving
| ||||||
12 | continuing education or training approved by the EMS Medical
| ||||||
13 | Director. This Section shall also not prohibit an EMT,
EMT-I, | ||||||
14 | A-EMT, or Paramedic from seeking credentials other than his or | ||||||
15 | her EMT, EMT-I, A-EMT, or Paramedic
license and utilizing such | ||||||
16 | credentials to work in emergency
departments or other health | ||||||
17 | care settings under the
jurisdiction of that employer.
| ||||||
18 | (c) An EMT,
EMT-I, A-EMT, or Paramedic may honor Do Not | ||||||
19 | Resuscitate (DNR) orders and powers
of attorney for health care | ||||||
20 | only in accordance with rules
adopted by the Department | ||||||
21 | pursuant to this Act and protocols
of the EMS System in which | ||||||
22 | he or she practices.
| ||||||
23 | (d) A student enrolled in a Department approved EMS | ||||||
24 | personnel
program, while fulfilling the
clinical training and | ||||||
25 | in-field supervised experience
requirements mandated for | ||||||
26 | licensure or approval by the
System and the Department, may |
| |||||||
| |||||||
1 | perform prescribed procedures
under the direct supervision of a | ||||||
2 | physician licensed to
practice medicine in all of its branches, | ||||||
3 | a qualified
registered professional nurse, or qualified EMS | ||||||
4 | personnel, only when
authorized by the EMS Medical Director.
