Bill Title: Amends the Unified Code of Corrections relating to the additional child pornography fine. Provides that if Department of State Police officers investigated the case that gave rise to the conviction of the defendant for child pornography, the additional fine shall be remitted by the circuit clerk within one month after receipt to the State Treasurer for deposit into the State Crime Laboratory Fund. When the Department of State Police provides assistance to another law enforcement agency which investigated the case that gave rise to the conviction of the defendant for child pornography, $100 of the additional fine shall be remitted by the circuit clerk within one month after receipt to the State Treasurer for deposit into the State Crime Laboratory Fund.

AN ACT concerning criminal law.
| ||||
Be it enacted by the People of the State of Illinois,
| ||||
represented in the General Assembly:
| ||||
Section 5. The Unified Code of Corrections is amended by | ||||
changing Section 5-9-1.14 as follows:

Sec. 5-9-1.14. Additional child pornography fines. In | ||||
addition to any other penalty imposed, a fine of $500 shall be | ||||
imposed upon a person convicted of child pornography under | ||||
Section 11-20.1 of the Criminal Code of 1961 or the Criminal | ||||
Code of 2012 . The Such additional fine shall be assessed by the | ||||
court imposing sentence and shall be collected by the circuit | ||||
clerk. Of this fee, $5 shall be deposited into the Circuit | ||||
Court Clerk Operation and Administrative Fund created by the | ||||
circuit clerk Clerk of the Circuit Court to be used to offset | ||||
the costs incurred by the circuit clerk Circuit Court Clerk in | ||||
performing the additional duties required to collect and | ||||
disburse funds to entities of State and local government as | ||||
provided by law. Each such additional fine shall be remitted by | ||||
the circuit clerk Circuit Court Clerk within one month after | ||||
receipt to the unit of local or State government whose law | ||||
enforcement officers investigated the case that gave rise to | ||||
the conviction of the defendant for child pornography. When |
Department of State Police officers investigated the case that | ||
gave rise to the conviction of the defendant for child | ||
pornography, the additional fine shall be remitted by the | ||
circuit clerk within one month after receipt to the Department | ||
of State Police for deposit into the State Crime Laboratory | ||
Fund. When the Department of State Police provides digital or | ||
electronic forensic examination assistance, or both, to | ||
another law enforcement agency which investigated the case that | ||
gave rise to the conviction of the defendant for child | ||
pornography, $100 of the additional fine shall be remitted by | ||
the circuit clerk within one month after receipt to the | ||
Department of State Police for deposit into the State Crime | ||
Laboratory Fund.
