Bill Title: Amends the Illinois Income Tax Act. Creates an income tax checkoff for the Mental Health Income Tax Checkoff Fund. Amends the State Finance Act to create the Fund. Provides that moneys in the Fund may be used by the Department of Public Health for the purpose of making grants to providers of mental health services in the State. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The State Finance Act is amended by adding | ||||||||||||||||||||||||||||
5 | Sections 5.891 and 6z-107 as follows:

6 | (30 ILCS 105/5.891 new) | ||||||||||||||||||||||||||||
7 | Sec. 5.891. The Mental Health Income Tax Checkoff Fund.

9 | Sec. 6z-107. The Mental Health Income Tax Checkoff Fund; | ||||||||||||||||||||||||||||
10 | creation. The Mental Health Income Tax Checkoff Fund is created | ||||||||||||||||||||||||||||
11 | as a special fund in the State treasury. Moneys in the Fund | ||||||||||||||||||||||||||||
12 | shall be used by the Department of Public Health for the | ||||||||||||||||||||||||||||
13 | purpose of making grants to providers of mental health services | ||||||||||||||||||||||||||||
14 | in the State.

15 | Section 10. The Illinois Income Tax Act is amended by | ||||||||||||||||||||||||||||
16 | adding Section 507JJJ as follows:

17 | (35 ILCS 5/507JJJ new) | ||||||||||||||||||||||||||||
18 | Sec. 507JJJ. Mental Health checkoff. For taxable
years | ||||||||||||||||||||||||||||
19 | ending on or after December 31, 2019, the Department must
print | ||||||||||||||||||||||||||||
20 | on its standard individual income tax form a provision

1 | indicating that if the taxpayer wishes to contribute to the
| ||||||
2 | Mental Health Income Tax Checkoff Fund, as authorized by this | ||||||
3 | amendatory Act of
the 101st General Assembly, he or she may do | ||||||
4 | so by stating the
amount of the contribution (not less than $1) | ||||||
5 | on the return and
(ii) stating that the contribution will | ||||||
6 | reduce the taxpayer's refund or
increase the amount of payment | ||||||
7 | to accompany the return. Failure
to remit any amount of | ||||||
8 | increased payment shall reduce the
contribution accordingly. | ||||||
9 | This Section does not apply to any
amended return.

10 | Section 99. Effective date. This Act takes effect upon | ||||||
11 | becoming law.
