Bill Title: Creates the Term Limit Referendum Act. Requires the State Board of Elections to cause a statewide advisory public question to be submitted to the voters at the 2018 general election asking whether there should be term limits for State Senators and State Representatives and whether executive officials should serve no more than 2 consecutive terms of office. Provides that if any provision of the Act conflicts with any other law, the Act controls. Repeals the Act on January 1, 2019. Effective immediately.

1 | AN ACT concerning elections.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 1. Short title. This Act may be cited as the Term | |||||||||||||||||||
5 | Limit Referendum Act.

6 | Section 5. Referendum. The State Board of Elections shall | |||||||||||||||||||
7 | cause a statewide advisory public question to be submitted to | |||||||||||||||||||
8 | the voters at the general election to be held on November 6, | |||||||||||||||||||
9 | 2018. The question shall appear in the following form:

10 | "If the following amendment adding the underlined language | |||||||||||||||||||
11 | to the Illinois Constitution were proposed at the next | |||||||||||||||||||
12 | election, should the amendment be passed?
| |||||||||||||||||||
13 | By adding Section 2.5 to Article IV as follows: | |||||||||||||||||||
14 | " SECTION 2.5. TERM LIMITS | |||||||||||||||||||
15 | A person may not hold the office of State Senator or | |||||||||||||||||||
16 | State Representative or a combination of those offices for | |||||||||||||||||||
17 | more than 20 years; provided that service before the second | |||||||||||||||||||
18 | Wednesday in January of 2021 shall not be considered in the | |||||||||||||||||||
19 | calculation of a person's service. "

20 | And by amending Section 2 of Article V of the Illinois |

1 | Constitution as follows: | ||||||
2 | "SECTION 2. TERMS | ||||||
3 | (a) These elected officers of the Executive Branch | ||||||
4 | shall hold office for four years beginning on the second | ||||||
5 | Monday of January after their election and, except in the | ||||||
6 | case of the Lieutenant Governor, until their successors are | ||||||
7 | qualified. They shall be elected at the general election in | ||||||
8 | 1978 and every four years thereafter. | ||||||
9 | (b) A person may not serve more than 2 consecutive | ||||||
10 | terms of office within the same Executive Branch office. A | ||||||
11 | person who has served 2 consecutive terms within the same | ||||||
12 | Executive Branch office may not serve another term of | ||||||
13 | office in that office until 8 years after the conclusion of | ||||||
14 | the person's second consecutive term. | ||||||
15 | A person is considered to serve a term of office for | ||||||
16 | the purpose of this subsection if the person is elected or | ||||||
17 | appointed to serve any portion of the term." "

18 | The votes on the question shall be recorded as "Yes" or "No".

19 | Section 10. Certification. The State Board of Elections | ||||||
20 | shall immediately certify the question to be submitted to the | ||||||
21 | voters of the entire State under Section 5 to each election | ||||||
22 | authority in Illinois.

23 | Section 15. Conflicts. If any provision of this Act |

1 | conflicts with any other law, this Act controls.

2 | Section 90. Repeal. This Act is repealed on January 1, | ||||||
3 | 2019.
