Bill Title: Creates the Local Initiative Sunshine Act. Provides that, beginning on July 1, 2013 or on the effective date of the Act, whichever is later, the Office of the Comptroller shall create and maintain a searchable database website to provide information concerning recipients of gubernatorial or legislative member initiatives. Sets forth the requirements for the database website. Defines "gubernatorial or legislative member initiatives". Effective immediately.

1 | AN ACT concerning State government.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||
4 | Section 1. Short title. This Act may be cited as the Local | ||||||||||||||||||||||||
5 | Initiative Sunshine Act.
| ||||||||||||||||||||||||
6 | Section 5. Definitions. In this Act: | ||||||||||||||||||||||||
7 | "Gubernatorial or legislative member initiative" means a | ||||||||||||||||||||||||
8 | grant from State funds to a specific unit of local government, | ||||||||||||||||||||||||
9 | specific school district, specific not-for-profit | ||||||||||||||||||||||||
10 | organization, or specific non-governmental entity for | ||||||||||||||||||||||||
11 | infrastructure improvements or operating expenses. Grants that | ||||||||||||||||||||||||
12 | are part of a statewide program and are based on generally | ||||||||||||||||||||||||
13 | applicable standards of eligibility are not gubernatorial or | ||||||||||||||||||||||||
14 | legislative member initiatives. | ||||||||||||||||||||||||
15 | "Infrastructure
improvements" include without limitation | ||||||||||||||||||||||||
16 | capital improvements, capital
projects, planning, | ||||||||||||||||||||||||
17 | construction, reconstruction, equipment, utilities,
vehicles, | ||||||||||||||||||||||||
18 | and all costs associated with economic development, community
| ||||||||||||||||||||||||
19 | programs, educational programs, public health, and public | ||||||||||||||||||||||||
20 | safety. | ||||||||||||||||||||||||
21 | "Initiative sponsor", with respect to each gubernatorial | ||||||||||||||||||||||||
22 | or legislative member initiative, includes the Governor and | ||||||||||||||||||||||||
23 | each member of the General Assembly designated in the grant |

1 | application as having requested or initiated the grant. | ||||||
2 | "Initiative recipient" means an individual or entity that | ||||||
3 | is designated to receive or receives a gubernatorial or | ||||||
4 | legislative member initiative. | ||||||
5 | "Recoverable grants" mean grant money to an initiative | ||||||
6 | recipient that has been determined, in accordance with | ||||||
7 | applicable State law and rule, to be refundable to the State. | ||||||
8 | "Searchable database website" means a website that allows | ||||||
9 | the public to (i) search the database by name of initiative | ||||||
10 | recipient, initiative sponsor, funding agency, and location of | ||||||
11 | performed and recoverable grants and (ii) download data | ||||||
12 | included in item (i), including outcomes from searches.

13 | Section 10. Purpose. The purpose of this Act is to provide | ||||||
14 | full and complete disclosure to the public of the recipients of | ||||||
15 | gubernatorial and legislative member initiatives. The database | ||||||
16 | shall also serve as a warning to initiative recipients that the | ||||||
17 | misuse of public funds will not be tolerated by the State.

18 | Section 15. Initiative recipient database. | ||||||
19 | (a) Beginning on July 1, 2013 or on the effective date of | ||||||
20 | this Act, whichever is later, the Office of the Comptroller | ||||||
21 | shall create and maintain a searchable database website | ||||||
22 | containing information concerning initiative recipients. The | ||||||
23 | database shall include for each initiative recipient: | ||||||
24 | (1) the name of the initiative recipient and initiative |

1 | sponsor; | ||||||
2 | (2) the amount of the gubernatorial or legislative | ||||||
3 | member initiative; | ||||||
4 | (3) the funding agency and the funding source; | ||||||
5 | (4) the purpose of each initiative; | ||||||
6 | (5) the location of the initiative recipient and the | ||||||
7 | primary location of the performance of the initiative; | ||||||
8 | (6) any recoverable grants; and | ||||||
9 | (7) any other relevant information. | ||||||
10 | (b) The database website shall also provide an opportunity | ||||||
11 | for the public to provide input about the utility of the | ||||||
12 | website and recommendations for improvements. | ||||||
13 | (c) The database website shall not be considered in | ||||||
14 | compliance with this Act if it relies upon links to other | ||||||
15 | existing websites and databases, unless each of those sites has | ||||||
16 | information from all agencies and each category of information | ||||||
17 | required to be itemized can be searched electronically by field | ||||||
18 | in a single search.

19 | Section 99. Effective date. This Act takes effect upon | ||||||
20 | becoming law.
