Bill Title: Amends the Public Officer Prohibited Activities Act. Authorizes a supervisor or trustee of a township with fewer than 2,500 inhabitants, during the term of office for which the supervisor or trustee is elected, to hold the office of school board member for a school district. Amends the Township Code. Provides that a township board may not direct a distribution to be made from the township's general fund to a school district if a supervisor or trustee of the township is concurrently serving as a school board member of that school district. Effective immediately.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Public Officer Prohibited Activities Act is
5amended by adding Section 1.4 as follows:
6 (50 ILCS 105/1.4 new)
7 Sec. 1.4. Supervisor or trustee of township with fewer
8than 2,500 inhabitants; authorization to serve on school
9board. A supervisor or trustee of a township with fewer than
102,500 inhabitants, during the term of office for which the
11supervisor or trustee is elected, may concurrently serve as a
12school board member of a school district.
13 Section 10. The Township Code is amended by changing
14Section 260-5 as follows:
15 (60 ILCS 1/260-5)
16 Sec. 260-5. Distributions from general fund, generally.
17 (a) To the extent that moneys in the township general fund
18have not been appropriated for other purposes, the township
19board may direct that distributions be made from that fund as
20follows:
21 (1) To (i) school districts maintaining grades 1

1 through 8 that are wholly or partly located within the
2 township or (ii) governmental units as defined in Section
3 1 of the Community Mental Health Act that provide mental
4 health facilities and services (including facilities and
5 services for persons with intellectual disabilities) under
6 that Act within the township, or (iii) both.
7 (2) To community action agencies that serve township
8 residents. "Community action agencies" are defined as in
9 Part A of Title II of the federal Economic Opportunity Act
10 of 1964.
11 (b) Notwithstanding subsection (a), a township board may
12not direct a distribution to be made from the township's
13general fund to a school district if a supervisor or trustee of
14the township is concurrently serving as a school board member
15for that school district.
