Bill Title: Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Illinois Insurance Code, the Health Maintenance Organization Act, and the Voluntary Health Services Plans Act. Provides that an individual or group policy of accident and health insurance or managed care plan must provide coverage for intravenous feeding. Amends the State Mandates Act to require implementation without reimbursement by the State.

AMENDMENT TO HOUSE BILL 1267
2 AMENDMENT NO. ______. Amend House Bill 1267, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41 as follows:
5on page 6, by replacing lines 1 through 10 with the following:
6 "(215 ILCS 5/356z.19 new)
7 Sec. 356z.19. Nutritional support and hydration.
8 (a) The General Assembly finds that people who are
9physically unable to swallow, digest, or absorb food and fluids
10taken by mouth are at risk of malnutrition and dehydration.
11Without nutritional support and hydration, such individuals
12will become increasingly weakened. As their immune system
13functioning is reduced, they may die from infections before
14death can occur from malnutrition or dehydration.
15 (b) A group or individual policy of accident and health
16insurance or managed care plan amended, delivered, issued, or

1renewed after the effective date of this amendatory Act of the
297th General Assembly must provide coverage for intravenous
3feeding and for enteral or tube feeding. The benefits under
4this Section shall be at least as favorable as for other
5coverages under the policy and may be subject to the same
6dollar amount limits, deductibles, and co-insurance
7requirements applicable generally to other coverages under the
8policy.
9 (c) For the purpose of this Section, "enteral or tube
10feeding" means the process by which nutritional formulas are
11delivered via a tube into the digestive tract.".
