Bill Title: Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Creates the Local Government Road Salt Purchase Reimbursement Fund. Provides that moneys in the Fund shall be used by the Department of Transportation to make grants to counties, municipalities, townships, and road districts in the northeastern Illinois region that entered into contracts for the purchase of road salt for the 2008-2009 winter season at a rate that exceeds the regional average. Amends the State Finance Act. Provides that the sum of $14,500,000 shall be transferred from the Fund for Illinois' Future to the Local Government Road Salt Purchase Reimbursement Fund. Effective immediately.

1 AN ACT concerning finance.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of Transportation Law of the
5 Civil Administrative Code of Illinois is amended by adding
6 Section 2705-585 as follows:
7 (20 ILCS 2705/2705-585 new)
8 Sec. 2705-585. Local Government Road Salt Purchase
9 Reimbursement Fund.
10 (a) The Local Government Road Salt Purchase Reimbursement
11 Fund is hereby created as a special fund in the State Treasury.
12 Moneys in the Fund shall be used by the Department to make
13 grants to counties, municipalities, townships, and road
14 districts in the northeastern Illinois region that
15 participated in the original bid process with the Department of
16 Central Management Services and entered into contracts for the
17 purchase of road salt for the 2008-2009 winter season at a rate
18 that exceeds the northeastern Illinois regional average cost
19 per ton for the 2008-2009 winter season in the original bid
20 process, as determined by the Department of Central Management
21 Services.
22 (b) Grant applications must be submitted within 150 days
23 after the effective date of this amendatory Act of the 96th

1 General Assembly. Grants shall be awarded in an amount equal to
2 the difference between (i) the amount of the contract price
3 negotiated by the county, municipality, township, or road
4 district for only the tonnage of road salt designated for that
5 county, municipality, township, or road district in the
6 original Central Management Services contract and (ii) the
7 amount for that tonnage of road salt based upon the
8 northeastern Illinois regional average cost per ton in the
9 original Central Management Services bid process, as
10 determined by the Department of Central Management Services,
11 but grant amounts may be prorated if moneys in the Fund are not
12 sufficient to cover the grants awarded. Grants may be awarded
13 only for the 2008-2009 winter season.
14 (c) The Secretary of Transportation shall certify to the
15 Comptroller and Treasurer when all grants have been made for
16 the 2008-2009 winter season. If any amount then remains in the
17 Fund, the Comptroller shall order transferred and the Treasurer
18 shall transfer that amount from the Local Government Road Salt
19 Purchase Reimbursement Fund to the Fund for Illinois' Future,
20 and the Local Government Road Salt Purchase Reimbursement Fund
21 is thereupon dissolved.
22 Section 10. The State Finance Act is amended by changing
23 Section 6z-47 and by adding Section 5.719 as follows:

4 Sec. 6z-47. Fund for Illinois' Future.
5 (a) The Fund for Illinois' Future is hereby created as a
6 special fund in the State Treasury.
7 (b) Upon the effective date of this amendatory Act of the
8 91st General Assembly, or as soon as possible thereafter, the
9 Comptroller shall order transferred and the Treasurer shall
10 transfer $260,000,000 from the General Revenue Fund to the Fund
11 for Illinois' Future.
12 On July 15, 2000, or as soon as possible thereafter, the
13 Comptroller shall order transferred and the Treasurer shall
14 transfer $260,000,000 from the General Revenue Fund to the Fund
15 for Illinois' Future.
16 Revenues in the Fund for Illinois' Future shall include any
17 other funds appropriated or transferred into the Fund.
18 (c) Moneys in the Fund for Illinois' Future may be
19 appropriated for the making of grants and expenditures for
20 planning, engineering, acquisition, construction,
21 reconstruction, development, improvement, and extension of
22 public infrastructure in the State of Illinois, including
23 grants to local governments for public infrastructure, grants
24 to public elementary and secondary school districts for public
25 infrastructure, grants to universities, colleges, community

1 colleges, and non-profit corporations for public
2 infrastructure, and expenditures for public infrastructure of
3 the State and other related purposes, including but not limited
4 to expenditures for equipment, vehicles, community programs,
5 and recreational facilities.
6 (d) As soon as possible after the effective date of this
7 amendatory Act of the 96th General Assembly, the Comptroller
8 shall order transferred and the Treasurer shall transfer
9 $14,500,000 from the Fund for Illinois' Future to the Local
10 Government Road Salt Purchase Reimbursement Fund.

12 Section 99. Effective date. This Act takes effect upon
