Bill Title: Amends the Liquor Control Act of 1934. Provides that no alcoholic liquor that combines alcohol with caffeine, guarana, or other similar substances that are commonly referred to as "caffeinated alcohol beverages" may be imported into the State or produced, manufactured, distributed, sold, or offered for sale in this State by a licensee under the Act. Makes other changes.

2 | AMENDMENT NO. ______. Amend House Bill 1327 on page 3, by | ||||||
3 | replacing lines 5 through 25 with the following:

4 | "(235 ILCS 5/6-36 new) | ||||||
5 | Sec. 6-36. Caffeinated or stimulant-enhanced malt | ||||||
6 | beverages. | ||||||
7 | (a) For purposes of this Section, "caffeinated or | ||||||
8 | stimulant-enhanced malt beverage" means a prepackaged malt | ||||||
9 | beverage that contains (1) added caffeine or another stimulant, | ||||||
10 | including guarana, ginseng, or taurine and (2) at least 1% | ||||||
11 | alcohol by volume. | ||||||
12 | (b) No person shall offer for sale a caffeinated or | ||||||
13 | stimulant-enhanced malt beverage in this State. | ||||||
14 | (c) A person who violates this Section shall be subject to | ||||||
15 | a penalty of not more than $1,000. "; and
