Bill Title: Creates the Access to Medically Necessary Vaccinations Act. Provides that any health care provider in this State must provide a vaccination to a patient if: the patient has requested the specific vaccination to be administered; the health care provider has determined that the vaccination is medically necessary; and the health care provider has a stock of one or more doses of the vaccination that have not been reserved for another patient. Prohibits a health care provider from preventing a medically necessary vaccination from being administered to a patient by keeping separate stocks of the vaccination for patients with private insurance and stocks of the vaccination for patients with Medicaid.

1 AN ACT concerning health.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the Access
5to Medically Necessary Vaccinations Act.
6 Section 5. Purpose. The purpose of this Act is to allow
7patients to receive medically necessary vaccinations while the
8licensed health care facility retains a stock of the
9vaccination, regardless of whether the patient has coverage
10under a private insurance plan or Medicaid.
11 Section 10. Definitions. As used in this Act:
12 "Health care provider" means any public or private
13facility that is licensed to provide, on an inpatient or
14outpatient basis, preventive, diagnostic, therapeutic,
15convalescent, rehabilitation, mental health, or intellectual
16disability services, including general or special hospitals,
17skilled nursing homes, extended care facilities, intermediate
18care facilities and mental health centers. "Health care
19provider" includes any physician or other person that is
20licensed or otherwise authorized to deliver health care
21services, including the administration of vaccinations.
22 "Medically necessary vaccination" means a vaccination that

1will or is reasonably expected to (1) prevent the onset of an
2illness, condition, injury, disease, or disability; (2) reduce
3or ameliorate the physical, mental, or developmental effects
4of an illness, condition, injury, disease, or disability; or
5(iii) assist the achievement or maintenance of maximum
6functional activity in performing daily activities.
7 "Patient" means any individual who has received or is
8receiving medical care, treatment, or services from an
9individual or institution licensed to provide medical care or
10treatment in this State.
11 Section 15. Administration of medically necessary
12vaccinations. A health care provider in this State must
13provide a vaccination to a patient if:
14 (1) the patient has requested the specific vaccination
15 to be administered;
16 (2) the health care provider has determined that the
17 vaccination is a medically necessary vaccination; and
18 (3) the health care provider has a stock of one or more
19 doses of the vaccination that have not been reserved for
20 another named patient.
21 Section 20. Prohibition on separate stocks. A health care
22provider shall not prevent a medically necessary vaccination
23from being administered to a patient by keeping separate
24stocks of the vaccination for patients with private insurance
