2 | AMENDMENT NO. ______. Amend House Bill 1729 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Emergency Medical Services (EMS) Systems | ||||||
5 | Act is amended by changing Section 2 as follows:
| ||||||
6 | (210 ILCS 50/2) (from Ch. 111 1/2, par. 5502)

7 | Sec. 2. Legislative intent; construction of Act. The | ||||||
8 | Legislature finds and declares that emergency medical
services | ||||||
9 | are essential services in the State of Illinois and it is the | ||||||
10 | intent of
this legislation to provide the State with systems | ||||||
11 | for
emergency medical
services by establishing within the State | ||||||
12 | Department of Public Health a central
authority responsible for | ||||||
13 | the coordination and integration of all activities within the | ||||||
14 | State concerning pre-hospital and
inter-hospital emergency | ||||||
15 | medical services, as well as non-emergency
medical transports, | ||||||
16 | and
the overall planning, evaluation,
and regulation of |

1 | pre-hospital emergency medical services systems.
| ||||||
2 | The provisions of this Act shall not be construed to deny | ||||||
3 | emergency medical
services to persons outside the boundaries of | ||||||
4 | this State nor to limit,
restrict,
or prevent any cooperative | ||||||
5 | agreement for the provision of emergency medical
services | ||||||
6 | between this State, or any of its political subdivisions, and | ||||||
7 | any
other State or its political subdivisions or a federal | ||||||
8 | agency.

9 | The provisions of this Act shall not be construed to
| ||||||
10 | regulate the emergency transportation of persons by friends
or | ||||||
11 | family members, in personal vehicles that are not
ambulances, | ||||||
12 | specialized emergency medical service vehicles,
first response | ||||||
13 | vehicles or medical carriers.
| ||||||
14 | This legislation is intended to provide minimum
standards | ||||||
15 | for the statewide delivery of EMS services. It
is recognized, | ||||||
16 | however, that diversities exist between
different areas of the | ||||||
17 | State, based on geography, location
of health care facilities, | ||||||
18 | availability of personnel, and
financial resources. The | ||||||
19 | Legislature therefore intends that
the implementation and | ||||||
20 | enforcement of this Act by
the Illinois Department of Public | ||||||
21 | Health accommodate those
varying needs and interests to the | ||||||
22 | greatest extent possible
without jeopardizing appropriate | ||||||
23 | standards of medical care,
through the Department's exercise of | ||||||
24 | the waiver provision of
this Act and its adoption of rules | ||||||
25 | pursuant to this Act.
