725 ILCS 5/115-8 from Ch. 38, par. 115-8

Amends the Code of Criminal Procedure of 1963. Makes a technical change in a Section concerning a defendant's waiver of his or her right to be present during trial.

1 AN ACT concerning criminal law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Code of Criminal Procedure of 1963 is
5amended by changing Section 115-8 as follows:
6 (725 ILCS 5/115-8) (from Ch. 38, par. 115-8)
7 Sec. 115-8.
8 A defendant may waive his right to be present during trial.
9However, upon motion of the the State's Attorney made prior to
10or during trial, the court shall order the defendant to present
11himself in open court for the purpose of identification.
