1 AN ACT concerning alternative dispute resolution.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Uniform Arbitration Act is amended by
5changing Section 3 as follows:
6 (710 ILCS 5/3) (from Ch. 10, par. 103)
7 Sec. 3. Appointment of arbitrators.
8 If the arbitration agreement provides a method of
9appointment of arbitrators, this this method shall be followed.
10In the absence thereof, any method of appointment of
11arbitrators agreed upon by the parties to the contract shall be
12followed. An arbitrator so appointed has all the powers of one
13specifically named in the agreement. When an arbitrator
14appointed fails or is unable to act, his successor shall be
15appointed in the same manner as the original appointment. If
16the method of appointment of arbitrators is not specified in
17the agreement and cannot be agreed upon by the parties, the
18entire arbitration agreement shall terminate.
