1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Code of Criminal Procedure of 1963 is | |||||||||||||||||||
5 | amended by changing Section 107-5 as follows:

6 | (725 ILCS 5/107-5) (from Ch. 38, par. 107-5)

7 | Sec. 107-5. Method of arrest.

8 | (a) An arrest is made by an actual restraint of the

submission to custody. | |||||||||||||||||||
10 | (b) An arrest may be made on any day and at any time of the | |||||||||||||||||||
11 | day or
night.

12 | (c) An arrest may be made anywhere within the jurisdiction | |||||||||||||||||||
13 | of this
State.

14 | (d) All necessary and reasonable force may be used to | |||||||||||||||||||
15 | effect an entry
into any building or property or part thereof | |||||||||||||||||||
16 | to make an authorized arrest.
