Bill Title: Amends the Illinois Food, Drug and Cosmetic Act. Prohibits the sale, offering for sale, or delivery of an energy drink containing stimulants, including, but not limited to, caffeine, taurine, or guarana to a person under 18 years of age. Provides that the Director of the Department of Public Health is authorized to file a complaint and seek a temporary restraining order or preliminary or permanent injunction restraining the sale, offering for sale, or delivery of an energy drink to a person under 18 years of age.

AMENDMENT TO HOUSE BILL 2058
2 AMENDMENT NO. ______. Amend House Bill 2058 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Food, Drug and Cosmetic Act is
5amended by adding Section 3.24 as follows:
6 (410 ILCS 620/3.24 new)
7 Sec. 3.24. Energy drinks. For the purpose of this Section,
8"energy drink" means any soft drink with a caffeine level of 6
9mg or more per ounce. It is unlawful in this State for any
10person to sell, offer for sale, or deliver an energy drink to a
11person under 18 years of age. In addition to any other remedies
12provided by law, the Director is authorized to file a complaint
13and apply to the circuit court for, and such court may upon
14hearing and for cause shown grant, a temporary restraining
15order or preliminary or permanent injunction restraining any
16person from violating any provision of this Section.".
