Bill Title: Amends the Mercury-added Product Prohibition Act. Provides that, by January 1, 2010, the Environmental Protection Agency shall adopt rules requiring each manufacturer of mercury-containing compact fluorescent lamps and mercury-containing compact fluorescent bulbs to display certain information on the packaging of those products. Requires the Agency to compile and publish on its website a report providing certain information about mercury-containing compact fluorescent lighting sold or distributed in the State. Requires the Agency, by January 1, 2010, to publish on its website information regarding the safe and proper disposal of mercury-containing compact fluorescent lighting. Effective immediately.

1 AN ACT concerning health.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Mercury-added Product Prohibition Act is
5 amended by adding Section 40 as follows:
6 (410 ILCS 46/40 new)
7 Sec. 40. Mercury-containing compact fluorescent lighting;
8 Internet Web site and outreach; procurement.
9 (a) By October 1, 2009, the Agency shall create a Web site
10 that provides information on the mercury content of compact
11 fluorescent lamps used in residential applications, what to do
12 when a fluorescent lamp breaks, and options for consumers to
13 safely manage and recycle spent mercury-containing compact
14 fluorescent lamps generated in the State. The Agency shall also
15 collaborate with lamp manufacturers, retailers, utilities,
16 local governments, environmental organizations, and solid
17 waste haulers on outreach efforts to inform consumers about the
18 safe and proper management of spent mercury-containing
19 fluorescent lamps. In developing an outreach strategy, the
20 Agency shall consider a variety of media and methods for
21 disseminating information, including, but not limited to,
22 point of sale information, newspaper and magazine
23 advertisements, Web sites, package markings, bill inserts,

1 public service announcements, and stickers for dumpsters and
2 trash bins.
3 (b) By March 1, 2010, the Department of Central Management
4 Services, in collaboration with the Department of Commerce and
5 Economic Opportunity and the Agency, shall review and revise
6 procurement specifications for lamps and ballasts purchased by
7 State agencies. The specifications shall be revised to optimize
8 energy efficiency, toxics reduction, lighting quality, and
9 lamp life, taking into account performance, availability and
10 cost considerations. After July 1, 2010, the Department of
11 Central Management Services shall ensure that the
12 environmental and performance specifications developed under
13 this subsection are incorporated into bid solicitations
14 issued, and contracts entered into, for lamps and ballasts
15 purchased by State agencies.
16 (c) For the purposes of this subsection,
17 (1) "Lamp" means the bulb or tube portion of an
18 electrical lighting device, including, but not limited to,
19 a compact fluorescent lamp; a linear, circular or u-bent
20 tube; a high intensity discharge lamp; or an exit sign lamp
21 or fixture.
22 (2) "Ballast" means a device used to provide and
23 control the voltage in a linear fluorescent lamp.
24 Section 99. Effective date. This Act takes effect upon
25 becoming law.
