Bill Title: Amends the Illinois Petroleum Education and Marketing Act. Provides that, beginning on the effective date of the amendatory Act, the Director of Natural Resources shall make appointments to the Board, of which 10 shall be oil and gas producers. Authorizes the Director of Natural Resources to make these appointments based on names submitted to the Department of Natural Resources by oil and gas producers in the State. Effective immediately.

    Amends the Illinois Petroleum Education and Marketing Act. 1    AN ACT concerning regulation.
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4    Section 5. The Illinois Petroleum Education and Marketing
5Act is amended by changing Section 10 as follows:
6    (225 ILCS 728/10)
7    (Section scheduled to be repealed on January 1, 2028)
8    Sec. 10. Illinois Petroleum Resources Board.
9    (a) There is hereby created the Illinois Petroleum
10Resources Board, which shall be subject to the provisions of
11the Regulatory Sunset Act. The purpose of the Board is to
12coordinate a program designed to demonstrate to the general
13public the importance of the Illinois oil and gas exploration
14and production industry, to encourage the wise and efficient
15use of energy, to promote environmentally sound production
16methods and technologies, to develop existing supplies of
17State oil and gas resources, to support research and
18educational activities concerning the oil and gas exploration
19and production industry, and to support oilfield environmental
20remediation and restoration activities.
21    (b) The Board shall be composed of 12 members to be
22appointed as follows:
23        (1) Through December 31, 2006, the Governor shall make

1 appointments from a list of names submitted by qualified
2 producer associations, of which 10 shall be oil and gas
3 producers.
4        (2) Beginning January 1, 2007 and through the
5 effective date of this amendatory Act of the 104th General
6 Assembly, all appointments shall be made by the qualified
7 producer associations.
8        (3) Beginning on the effective date of this amendatory
9 Act of the 104th General Assembly, the Director of Natural
10 Resources shall make appointments to the Board, of which
11 10 shall be oil and gas producers. The Director may make
12 these appointments based on names submitted to the
13 Department of Natural Resources by oil and gas producers
14 in the State.    
15    (c) A member of the Board shall:
16        (1) be at least 25 years of age;
17        (2) be a resident of the State of Illinois; and
18        (3) have at least 5 years of active experience in the
19 oil industry.
20    (d) Members shall serve for a term of 3 years, except that
21of the initial appointments, 4 members shall serve for one
22year, 4 members for 2 years, and 4 members for 3 years.
23    (e) Vacancies shall be filled for the unexpired term of
24office in the same manner as the original appointment.
25    (f) The Board shall, at its first meeting, elect one of its
26members as chairperson, who shall preside over meetings of the

1Board and perform other duties that may be required by the
2Board. The first meeting of the Board shall be called by the
3Governor.
4    (g) No member of the Board shall receive a salary or
5reimbursement for duties performed as a member of the Board,
6except that members are eligible to receive reimbursement for
7travel expenses incurred in the performance of Board duties.

9    Section 99. Effective date. This Act takes effect upon
10becoming law.
