Bill Title: Amends various Acts relating to the governance of public universities and community colleges in Illinois. Provides that, in determining whether an individual is an Illinois resident, if the individual enrolls or attains credits at a public or private elementary school in this State, a public or private high school in this State, an adult school organized under the Public Community College Act, or a community college campus organized under the Public Community College Act, or either graduated from a public or private high school or received the equivalent of a high school diploma in this State, attained an associate degree from a community college campus organized under the Public Community College Act, or fulfilled the minimum transfer requirements established by the college for students transferring from a campus of a community college organized under the Public Community College Act, then the individual can qualify as a resident (instead of requiring that the individual resided with his or her parent or guardian while attending a public or private high school in this State or graduated from a public or private high school or received the equivalent of a high school diploma in this State). Removes the requirement that the individual must attend school in this State for at least 3 years as of the date the individual graduated from high school or received the equivalent of a high school diploma to qualify as an Illinois resident.

Amends various Acts relating to the governance of public universities and community colleges in Illinois. 1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The University of Illinois Act is amended by
5changing Section 7e-5 as follows:
6 (110 ILCS 305/7e-5)
7 Sec. 7e-5. In-state tuition charge.
8 (a) Notwithstanding any other provision of law to the
9contrary, at a minimum, for tuition purposes, the Board of
10Trustees shall deem an individual an Illinois resident, until
11the individual establishes a residence outside of this State,
12if all of the following conditions are met:
13 (1) The individual enrolls in or attains credits at
14 any of the following: The individual resided with his or
15 her parent or guardian while attending a public or private
16 high school in this State.
17 (A) a public or private elementary school in this
18 State;
19 (B) a public or private high school in this State;
20 (C) an adult school organized under the Public
21 Community College Act; or
22 (D) a community college campus organized under the
23 Public Community College Act.

1 (2) The individual satisfies any of the following:
2 (A) the The individual graduated from a public or
3 private high school or received the equivalent of a
4 high school diploma in this State; .
5 (B) the individual attained an associate degree
6 from a community college campus organized under the
7 Public Community College Act; or
8 (C) the individual fulfilled the minimum transfer
9 requirements established by the University of Illinois
10 for students transferring from a campus of a community
11 college organized under the Public Community College
12 Act.
13 (3) (Blank.) The individual attended school in this
14 State for at least 3 years as of the date the individual
15 graduated from high school or received the equivalent of a
16 high school diploma.
17 (4) (Blank.) The individual registers as an entering
18 student in the University not earlier than the 2003 fall
19 semester.
20 (5) In the case of an individual who is not a citizen
21 or a permanent resident of the United States, the
22 individual provides the University with an affidavit
23 stating that the individual will file an application to
24 become a permanent resident of the United States at the
25 earliest opportunity the individual is eligible to do so.
26 This subsection (a) applies only to tuition for a term or

1semester that begins on or after May 20, 2003 (the effective
2date of Public Act 93-7). Any revenue lost by the University in
3implementing this subsection (a) shall be absorbed by the
4University Income Fund.
5 (b) If a person is on active military duty and stationed in
6Illinois, then the Board of Trustees shall deem that person
7and any of his or her dependents Illinois residents for
8tuition purposes. Beginning with the 2009-2010 academic year,
9if a person is on active military duty and is stationed out of
10State, but he or she was stationed in this State for at least 3
11years immediately prior to being reassigned out of State, then
12the Board of Trustees shall deem that person and any of his or
13her dependents Illinois residents for tuition purposes, as
14long as that person or his or her dependent (i) applies for
15admission to the University within 18 months of the person on
16active military duty being reassigned or (ii) remains
17continuously enrolled at the University. Beginning with the
182013-2014 academic year, if a person is utilizing benefits
19under the federal Post-9/11 Veterans Educational Assistance
20Act of 2008 or any subsequent variation of that Act, then the
21Board of Trustees shall deem that person an Illinois resident
22for tuition purposes. Beginning with the 2015-2016 academic
23year, if a person is utilizing benefits under the federal
24All-Volunteer Force Educational Assistance Program, then the
25Board of Trustees shall deem that person an Illinois resident
26for tuition purposes. Beginning with the 2019-2020 academic

1year, per the federal requirements for maintaining approval
2for veterans' education benefits under 38 U.S.C. 3679(c), if a
3person is on active military duty or is receiving veterans'
4education benefits, then the Board of Trustees shall deem that
5person an Illinois resident for tuition purposes for any
6academic quarter, semester, or term, as applicable.

8 Section 10. The Southern Illinois University Management
9Act is amended by changing Section 8d-5 as follows:
10 (110 ILCS 520/8d-5)
11 Sec. 8d-5. In-state tuition charge.

14deem an individual an Illinois resident, until the individual

17 State for at least 3 years as of the date the individual
18 graduated from high school or received the equivalent of a
19 high school diploma.
20 (4) (Blank.) The individual registers as an entering
21 student in the University not earlier than the 2003 fall
22 semester.

21 high school diploma.
22 (4) (Blank.) The individual registers as an entering
23 student in the University not earlier than the 2003 fall

3contrary, at a minimum, for tuition purposes, the Board shall
4deem an individual an Illinois resident, until the individual
5establishes a residence outside of this State, if all of the
6following conditions are met:
7 (1) The individual enrolls in or attains credits at
8 any of the following: The individual resided with his or
9 her parent or guardian while attending a public or private
10 high school in this State.
11 (A) a public or private elementary school in this
12 State;
13 (B) a public or private high school in this State;
14 (C) an adult school organized under the Public
15 Community College Act; or
16 (D) a community college campus organized under the
17 Public Community College Act.
18 (2) The individual satisfies any of the following:
19 (A) the The individual graduated from a public or
20 private high school or received the equivalent of a
21 high school diploma in this State; .
22 (B) the individual attained an associate degree
23 from a community college campus organized under the
24 Public Community College Act; or
25 (C) the individual fulfilled the minimum transfer
26 requirements established by Northeastern Illinois

1 University for students transferring from a campus of
2 a community college organized under the Public
3 Community College Act.
4 (3) (Blank.) The individual attended school in this
5 State for at least 3 years as of the date the individual
6 graduated from high school or received the equivalent of a

8 (4) (Blank.) The individual registers as an entering
9 student in the University not earlier than the 2003 fall
10 semester.
11 (5) In the case of an individual who is not a citizen
12 or a permanent resident of the United States, the
13 individual provides the University with an affidavit
14 stating that the individual will file an application to
15 become a permanent resident of the United States at the
16 earliest opportunity the individual is eligible to do so.
17 This subsection (a) applies only to tuition for a term or
18semester that begins on or after May 20, 2003 (the effective
19date of Public Act 93-7). Any revenue lost by the University in
20implementing this subsection (a) shall be absorbed by the
21University Income Fund.
22 (b) If a person is on active military duty and stationed in
23Illinois, then the Board shall deem that person and any of his
24or her dependents Illinois residents for tuition purposes.
25Beginning with the 2009-2010 academic year, if a person is on
26active military duty and is stationed out of State, but he or

1she was stationed in this State for at least 3 years
2immediately prior to being reassigned out of State, then the
3Board shall deem that person and any of his or her dependents
4Illinois residents for tuition purposes, as long as that

7duty being reassigned or (ii) remains continuously enrolled at
8the University. Beginning with the 2013-2014 academic year, if
9a person is utilizing benefits under the federal Post-9/11
10Veterans Educational Assistance Act of 2008 or any subsequent
11variation of that Act, then the Board shall deem that person an
12Illinois resident for tuition purposes. Beginning with the
132015-2016 academic year, if a person is utilizing benefits
14under the federal All-Volunteer Force Educational Assistance
15Program, then the Board shall deem that person an Illinois
16resident for tuition purposes. Beginning with the 2019-2020
17academic year, per the federal requirements for maintaining
18approval for veterans' education benefits under 38 U.S.C.
193679(c), if a person is on active military duty or is receiving
20veterans' education benefits, then the Board of Trustees shall
21deem that person an Illinois resident for tuition purposes for
22any academic quarter, semester, or term, as applicable.
