Bill Title: Amends the Boxing and Full-contact Martial Arts Act. Changes the definition of "amateur" to allow the person to receive a stipend for an athletic club or sponsor of the contestant to cover the cost of training and participation expenses not to exceed $1,500. Provides that "full-contact martial arts" includes, but is not limited to, mixed martial arts and kickboxing techniques. Defines "incumbent sanctioning body". Exempts the following from oversight by the Department of Financial and Professional Regulation: (1) amateur boxing or full-contact martial arts contests that occur in facilities owned, operated, or managed by a State, county, or local public entity and are conducted by a sanctioning body and (2) amateur boxing, martial arts, or full-contact martial arts contests that are sponsored by a not-for-profit organization and conducted by a sanctioning body. Requires the sponsor of a qualified contest exempt from Department oversight to notify the Department of its intent to sponsor events. Effective immediately.

1 | AN ACT concerning regulation.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Boxing and Full-contact Martial Arts Act is | ||||||
5 | amended by changing Sections 1, 6, and 12 as follows:

8 | Sec. 1. Short title and definitions.
| ||||||
9 | (a) This Act may be cited as the Boxing and Full-contact | ||||||
10 | Martial Arts Act.
| ||||||
11 | (b) As used in this Act:
| ||||||
12 | "Department" means the Department of Financial and
| ||||||
13 | Professional Regulation.
| ||||||
14 | "Secretary" means the Secretary
of Financial and | ||||||
15 | Professional Regulation.
| ||||||
16 | "Board" means the State of Illinois Athletic Board
| ||||||
17 | established pursuant to this Act.
| ||||||
18 | "License" means the license issued for
promoters,
| ||||||
19 | professionals, or officials
in accordance with this Act.
| ||||||
20 | "Professional contest" means a
boxing or full-contact | ||||||
21 | martial arts competition in which all of the participants | ||||||
22 | competing against one another are professionals and where | ||||||
23 | the public is able to attend or a fee is charged.

1 | "Permit" means the authorization from the Department | ||||||
2 | to a
promoter
to conduct professional or amateur contests, | ||||||
3 | or a combination of both.
| ||||||
4 | "Promoter" means a person who is licensed and
who
holds | ||||||
5 | a permit to conduct professional or amateur contests, or a | ||||||
6 | combination of both.
| ||||||
7 | Unless the context indicates otherwise, "person" | ||||||
8 | includes, but is not limited to, an individual,
| ||||||
9 | association, organization, business entity, gymnasium, or | ||||||
10 | club.
| ||||||
11 | "Judge" means a person licensed by the Department who | ||||||
12 | is
located at ringside or adjacent to the fighting area
| ||||||
13 | during a professional contest
and who has the | ||||||
14 | responsibility of scoring the performance of the
| ||||||
15 | participants in that professional contest.
| ||||||
16 | "Referee" means a person licensed by the Department who
| ||||||
17 | has the
general
supervision of
and is present inside of the | ||||||
18 | ring or fighting area during a professional contest.
| ||||||
19 | "Amateur" means a person registered by the Department | ||||||
20 | who is not competing for, and has never received or
| ||||||
21 | competed for, any
purse or other
article of value, directly | ||||||
22 | or indirectly, either for participating in any contest or | ||||||
23 | for the
expenses of training therefor,
other than a | ||||||
24 | non-monetary prize that does not exceed $50 in value.
| ||||||
25 | "Professional" means a person licensed by the
| ||||||
26 | Department who
competes for a
money prize, purse, or other |
| |||||||
| |||||||
1 | type of compensation in a professional contest held in
| ||||||
2 | Illinois.
| ||||||
3 | "Second" means a person licensed by the Department who | ||||||
4 | is
present at any professional
contest to provide | ||||||
5 | assistance or advice to a professional during the contest.
| ||||||
6 | "Matchmaker" means a person licensed by the Department | ||||||
7 | who
brings
together professionals to compete in
contests.
| ||||||
8 | "Manager" means a person licensed by the Department who | ||||||
9 | is
not a
promoter and
who, under contract, agreement, or | ||||||
10 | other arrangement, undertakes
to, directly or
indirectly, | ||||||
11 | control or administer the affairs of professionals.
| ||||||
12 | "Timekeeper" means a person licensed by the Department | ||||||
13 | who
is the
official timer of
the length of rounds and the | ||||||
14 | intervals between the rounds.
| ||||||
15 | "Purse" means the financial guarantee or any other
| ||||||
16 | remuneration for
which contestants
are participating in a | ||||||
17 | professional contest.
| ||||||
18 | "Physician" means a person licensed to practice | ||||||
19 | medicine
in all its
branches under the Medical Practice Act | ||||||
20 | of 1987.
| ||||||
21 | "Martial arts" means a discipline or combination of | ||||||
22 | different disciplines that utilizes sparring techniques | ||||||
23 | without the intent to injure, disable, or incapacitate | ||||||
24 | one's opponent, such as, but not limited to, Karate, Kung | ||||||
25 | Fu, Judo, Jujutsu, Tae Kwon Do, and Kyuki-Do. | ||||||
26 | "Full-contact martial arts" means the use of a singular |

1 | discipline or a combination of techniques from different | ||||||
2 | disciplines of the martial arts, including, without | ||||||
3 | limitation, full-force grappling, kicking, and striking | ||||||
4 | with the intent to injure, disable, or incapacitate one's | ||||||
5 | opponent.
| ||||||
6 | "Amateur contest" means a boxing or full-contact | ||||||
7 | martial arts competition in which all of the participants | ||||||
8 | competing against one another are amateurs and where the | ||||||
9 | public is able to attend or a fee is charged. | ||||||
10 | "Contestant" means a person who competes in either a | ||||||
11 | boxing or full-contact martial arts contest. | ||||||
12 | "Address of record" means the designated address | ||||||
13 | recorded by the Department in the applicant's or licensee's | ||||||
14 | application file, license file, or registration file as | ||||||
15 | maintained by the Department's licensure maintenance unit. | ||||||
16 | It is the duty of the applicant or licensee to inform the | ||||||
17 | Department of any change of address and those changes must | ||||||
18 | be made either through the Department's website or by | ||||||
19 | contacting the Department. | ||||||
20 | "Bout" means one match between 2 contestants. | ||||||
21 | "Sanctioning body" means an organization approved by | ||||||
22 | the Department under the requirements and standards stated | ||||||
23 | in this Act and the rules adopted under this Act to act as | ||||||
24 | a governing body that sanctions professional or amateur | ||||||
25 | contests. | ||||||
26 | "Kickboxing" means a form of boxing in which only |

6 | Sec. 6. Restricted contests and events. (a) All | ||||||
7 | professional and amateur contests, or a combination of both, in | ||||||
8 | which
physical contact is made are prohibited in Illinois | ||||||
9 | unless authorized by the Department pursuant to the | ||||||
10 | requirements and standards stated in this Act and the rules | ||||||
11 | adopted pursuant to this Act. This Section subsection (a) does | ||||||
12 | not apply to any of the following: | ||||||
13 | (1) Amateur boxing or full-contact martial arts | ||||||
14 | contests conducted by accredited secondary schools, | ||||||
15 | colleges, or universities, although a fee may be charged. | ||||||
16 | (2) Amateur boxing contests that are sanctioned by USA | ||||||
17 | Boxing or any other sanctioning organization approved by | ||||||
18 | the Association of Boxing Commissions. | ||||||
19 | (3) Amateur boxing or full-contact martial arts | ||||||
20 | contests conducted by a State, county, or municipal entity. | ||||||
21 | (4) Amateur martial arts contests that are not defined | ||||||
22 | as full-contact martial arts contests under this Act, | ||||||
23 | including, but not limited to, Karate, Kung Fu, Judo, | ||||||
24 | Jujutsu, Tae Kwon Do, and Kyuki-Do. | ||||||
25 | (5) Full-contact martial arts
contests, as defined by |

1 | this Act, that are recognized by
the International Olympic | ||||||
2 | Committee or are contested in
the Olympic Games and are not | ||||||
3 | conducted in an enclosed
fighting area or ring . | ||||||
4 | (6) Amateur kickboxing contests that are sanctioned by | ||||||
5 | nationally recognized sanctioning bodies, such as the | ||||||
6 | World Association of Kickboxing Organizations USA, KICK | ||||||
7 | International, the International Kickboxing Federation, | ||||||
8 | the International Sport Karate and Kickboxing Association, | ||||||
9 | and the World Kickboxing Association. | ||||||
10 | No other amateur boxing or full-contact martial arts | ||||||
11 | contests shall be permitted unless authorized by the | ||||||
12 | Department. | ||||||
13 | (b) The Department shall have the authority to determine | ||||||
14 | whether a professional or amateur contest is exempt for | ||||||
15 | purposes of this Section.

20 | Sec. 12. Professional or amateur contests. | ||||||
21 | (a) The professional or amateur contest, or a combination | ||||||
22 | of both,
shall be held in an area where adequate neurosurgical
| ||||||
23 | facilities are immediately available for skilled emergency
| ||||||
24 | treatment of an injured professional or amateur. | ||||||
25 | (b) Each professional or amateur shall be examined before |
| |||||||
| |||||||
1 | the contest
and promptly after each bout by a physician. The | ||||||
2 | physician
shall determine, prior to
the contest, if each | ||||||
3 | professional or amateur is physically fit to compete in the | ||||||
4 | contest.
After the bout the physician shall examine the | ||||||
5 | professional or amateur to
determine
possible injury. If the | ||||||
6 | professional's or amateur's physical condition so indicates, | ||||||
7 | the
physician shall recommend to the Department immediate | ||||||
8 | medical suspension. The physician or a licensed paramedic must | ||||||
9 | check the vital signs of all contestants as established by | ||||||
10 | rule. | ||||||
11 | (c)
The physician may, at any time during the professional | ||||||
12 | or amateur bout, stop the professional or amateur bout to
| ||||||
13 | examine a professional or amateur contestant and may direct the | ||||||
14 | referee to terminate the bout when, in the physician's opinion,
| ||||||
15 | continuing the bout could result in serious injury to the | ||||||
16 | professional or amateur. If the professional's or amateur's | ||||||
17 | physical condition so indicates, the physician shall recommend | ||||||
18 | to the Department immediate medical suspension. The
physician | ||||||
19 | shall certify to the condition of the professional or amateur | ||||||
20 | in writing, over
his signature on forms provided by the | ||||||
21 | Department. Such reports shall
be submitted to the Department | ||||||
22 | in a timely manner.
| ||||||
23 | (d) No professional or amateur contest, or a combination of
| ||||||
24 | both, shall be allowed to begin or be held unless
at least one | ||||||
25 | physician, at least one EMT and one paramedic, and one | ||||||
26 | ambulance have been contracted
with solely for the care of |
| |||||||
| |||||||
1 | professionals or amateurs who are competing as defined by rule.
| ||||||
2 | (e) No professional boxing bout shall be more than 12 | ||||||
3 | rounds in length. The rounds
shall not
be more than 3 minutes | ||||||
4 | each with a one minute interval between them, and
no | ||||||
5 | professional boxer shall be allowed to participate in more than | ||||||
6 | one contest within a 7-day period. | ||||||
7 | The number and length of rounds for all other professional | ||||||
8 | or amateur boxing or full-contact martial
arts contests, or a | ||||||
9 | combination of both, shall be determined by rule. | ||||||
10 | (f) The number and types of officials required for each | ||||||
11 | professional or amateur contest, or a combination of both, | ||||||
12 | shall be determined by rule.
| ||||||
13 | (g) The Department or its representative shall have
| ||||||
14 | discretion to declare
a price, remuneration,
or purse or any | ||||||
15 | part of it belonging to the professional withheld if in the
| ||||||
16 | judgment of the Department or its representative the | ||||||
17 | professional
is not honestly competing. | ||||||
18 | (h)
The Department shall have the authority to prevent a | ||||||
19 | professional or amateur contest, or a combination of
both,
from | ||||||
20 | being held and shall have the authority to stop a professional | ||||||
21 | or amateur contest, or a combination of
both, for noncompliance
| ||||||
22 | with any part of this Act or rules or when, in the judgment of | ||||||
23 | the Department,
or its representative, continuation of the | ||||||
24 | event would endanger the health,
safety, and welfare of the | ||||||
25 | professionals or amateurs or spectators. The Department's | ||||||
26 | authority to stop a contest on the basis that the professional |

1 | or amateur contest, or a combination of
both, would endanger | ||||||
2 | the health, safety, and welfare of the professionals or | ||||||
3 | amateurs or spectators shall extend to any professional or | ||||||
4 | amateur contest, or a combination of
both, regardless of | ||||||
5 | whether that amateur contest is exempted from the prohibition | ||||||
6 | in Section 6 of this Act. Department staff, or its | ||||||
7 | representative, may be present at any full-contact martial arts | ||||||
8 | contest with scheduled amateur bouts.

9 | (i) Participants of kickboxing contests must use, at a | ||||||
10 | minimum, 10 ounce gloves. | ||||||

12 | Section 99. Effective date. This Act takes effect upon | ||||||
13 | becoming law.
