Bill Title: Amends the Snow and Ice Removal Act. Includes within the protection of the Act a person in charge of any business who attempts to remove snow or ice from sidewalks and parking areas abutting the business. Prohibits liability unless the removal of the snow and ice was done in a willful or wanton manner. Provides that attorney's fees may be awarded to a defendant who is protected under the Act from liability if the court determines the that action against the defendant is frivolous.

    Amends the Snow and Ice Removal Act. 1    AN ACT concerning civil law.
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4    Section 5. The Snow and Ice Removal Act is amended by
5changing Sections 1 and 2 as follows:
6    (745 ILCS 75/1)    (from Ch. 70, par. 201)
7    Sec. 1. It is declared to be the public policy of this
8State that owners and others residing in residential units and
9owners and others operating businesses be encouraged to clean
10the sidewalks and parking areas abutting their residences and
11businesses of snow and ice. The General Assembly, therefore,
12determines that it is undesirable for any person to be found
13liable for damages due to his or her efforts in the removal of
14snow or ice from such sidewalks or parking areas, except for
15acts which amount to clear wrongdoing, as described in Section
162 of this Act.

19    Sec. 2. Any owner, lessor, occupant or other person in
20charge of any residential property or business, or any agent
21of or other person engaged by any such party, who removes or
22attempts to remove snow or ice from sidewalks or parking areas

1abutting the property shall not be liable for any personal
2injuries allegedly caused by the snowy or icy condition of the
3sidewalk or parking area resulting from his or her acts or
4omissions unless the alleged misconduct was willful or wanton.
5Attorney's fees may be awarded to a defendant who is protected
6under this Act in an action against the defendant determined
7by the court to be frivolous.
