Bill Title: Amends the Limitations Article of the Code of Civil Procedure. Provides that every civil claim or cause of action brought against any party alleging intentional or negligent acts or omissions by a person for physical, psychological, or other injury or condition suffered as a result of conduct which would constitute a sex offense under the Criminal Code of 2012 or incest, which is barred as of the effective date of the amendatory Act because the applicable period of limitation has expired, is revived; and the action then may be commenced not earlier than 6 months after and not later than 18 months after the effective date of the amendatory Act.

SYNOPSIS AS INTRODUCED:
735 ILCS 5/13-202.4 new

    Amends the Limitations Article of the Code of Civil Procedure. Provides that every civil claim or cause of action brought against any party alleging intentional or negligent acts or omissions by a person for physical, psychological, or other injury or condition suffered as a result of conduct which would constitute a sex offense under the Criminal Code of 2012 or incest, which is barred as of the effective date of the amendatory Act because the applicable period of limitation has expired, is revived; and the action then may be commenced not earlier than 6 months after and not later than 18 months after the effective date of the amendatory Act.

1    AN ACT concerning civil law.
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4    Section 5. The Code of Civil Procedure is amended by
5adding Section 13-202.4 as follows:
6    (735 ILCS 5/13-202.4 new)
7    Sec. 13-202.4. Adult and child sex offense revival.
8Notwithstanding any provision of law that imposes a period of
9limitation to the contrary, every civil claim or cause of
10action brought against any party alleging intentional or
11negligent acts or omissions by a person for physical,
12psychological, or other injury or condition suffered as a
13result of conduct which would constitute a sex offense under
14Article 11 of the Criminal Code of 2012 or incest, which is
15barred as of the effective date of this amendatory Act of the
16104th General Assembly because the applicable period of
17limitation has expired, is hereby revived; and the action then
18may be commenced not earlier than 6 months after and not later
19than 18 months after the effective date of this amendatory Act
20of the 104th General Assembly. In any such claim or action,
21dismissal of a previous action, ordered before the effective
22date of this amendatory Act of the 104th General Assembly, on
23grounds that such previous action was time barred, shall not

1be grounds for dismissal of a revival action under this
2Section.
3    The procedure for this Section shall be in accordance with
4the Supreme Court's rules.
