Bill Title: Amends the Illinois Vehicle Code and creates a new Chapter on autonomous vehicles. Defines the terms, "autonomous technology", "autonomous vehicle", "Secretary", "operator", and "manufacturer". Provides for the operation of autonomous vehicles on public roads for testing purposes. Provides that an autonomous vehicle shall not be driven for other than testing purposes unless the manufacturer submits an application meeting certain requirements, and that application is approved by the Secretary of State. Requires the Secretary to adopt regulations setting forth requirements for the submission of evidence of insurance, surety bond, or self-insurance, and the submission and approval of an application to operate an autonomous vehicle. Provides that the Secretary shall approve an application if the applicant has submitted all information and completed testing necessary to satisfy the Secretary that the autonomous vehicles are safe to operate on public roads and the applicant has complied with all requirements specified in the regulations adopted by the Secretary. Allows the Secretary to establish additional requirements by the adoption of regulations that he or she deems necessary to ensure the safe operation of autonomous vehicles on public roads. Allows the Secretary to promulgate regulations to assess a fee upon a manufacturer that submits an application to operate autonomous vehicles on public roads in an amount necessary to recover all costs reasonably incurred by the Secretary.

1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the | ||||||
5 | Automated Motor Vehicle Study and Report Act.
| ||||||
6 | Section 5. Definitions.
As used in this Act: | ||||||
7 | "Automated motor vehicle" means a vehicle capable of | ||||||
8 | operating in full automation mode, or the unconditional, | ||||||
9 | full-time performance by an automated driving system of all | ||||||
10 | aspects of the dynamic driving task, as defined by the Society | ||||||
11 | of Automotive Engineers in its information report J3016-2014.

12 | Section 10. The Automated Motor Vehicle Study and Report.
| ||||||
13 | (a) There is hereby created the Automated Motor Vehicle | ||||||
14 | Study and Report.
| ||||||
15 | (b) The Secretary of State shall conduct a study on the | ||||||
16 | feasibility of the operation of automated motor vehicles in | ||||||
17 | this State and produce a report on its findings. The report | ||||||
18 | shall include but not be limited to the following:
| ||||||
19 | (1) research on whether automated motor vehicles | ||||||
20 | reduce traffic fatalities and crashes by reducing or | ||||||
21 | eliminating driver error;
| ||||||
22 | (2) research on whether automated motor vehicles |

| |||||||
1 | reduce congestion and improve fuel economy through better | ||||||
2 | utilization of existing highway capacity and more | ||||||
3 | efficient operation of a vehicle's acceleration and | ||||||
4 | braking controls; and
| ||||||
5 | (3) recommendations on which, if any, current laws | ||||||
6 | should be amended to accommodate the introduction or | ||||||
7 | testing of automated motor vehicles in this State.

8 | (c) The Secretary shall submit the report and | ||||||
9 | recommendations, including recommended legislative action, to | ||||||
10 | the Governor and the General Assembly on or before July 1, | ||||||
11 | 2016.
| ||||||
12 | Section 15. Expiration. This Act is repealed on January 1, | ||||||
13 | 2017.
