Bill Title: Amends the Nursing Mothers in the Workplace Act. Changes the name of the Act to the Nursing in the Workplace Act. Provides that, if the employee prevails in that action, the employee shall be awarded reasonable attorney's fees and costs. Makes other changes. Effective immediately.

1    AN ACT concerning employment.
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4    Section 5. The Nursing Mothers in the Workplace Act is
5amended by changing Sections 1, 10, and 15 and by adding
6Section 20 as follows:

8    Sec. 1. Short title. This Act may be cited as the Nursing
9Mothers in the Workplace Act.

12    Sec. 10. Break time for nursing mothers. An employer shall
13provide reasonable break time to an employee who needs to
14express breast milk for the employee's her nursing infant
15child each time the employee has the need to express milk for
16one year after the child's birth. The break time may run
17concurrently with any break time already provided to the
18employee. An employer may not reduce an employee's
19compensation for time used for the purpose of expressing milk
20or nursing a baby. An employer shall provide reasonable break
21time as needed by the employee unless to do so would create an
22undue hardship as defined by item (J) of Section 2-102 of the

4    Sec. 15. Private place for nursing mothers. An employer
5shall make reasonable efforts to provide a room or other
6location, in close proximity to the work area, other than a
7toilet stall, where an employee described in Section 10 can
8express the employee's her milk in privacy.

11    Sec. 20. Private right of action. An employee who has been

13future denials of those rights. If the employee prevails in
14that action, the employee shall be awarded reasonable

16    Section 99. Effective date. This Act takes effect upon
17becoming law.
