Bill Title: Amends the Humane Care for Animals Act. Provides that no person may sell, offer for sale, barter, or give away as a pet or novelty any hermit crab or goldfish that has been dyed, colored, or otherwise treated to impart an artificial color. Provides that a violation is a Class B misdemeanor.

1 | AN ACT concerning animals.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Humane Care for Animals Act is amended by | ||||||
5 | changing Section 4 as follows:
| ||||||
6 | (510 ILCS 70/4) (from Ch. 8, par. 704)
| ||||||
7 | Sec. 4. Prohibited acts. No person may sell, offer for | ||||||
8 | sale, barter,
or give away as a pet or a novelty any rabbit ,
| ||||||
9 | hermit crab, goldfish, or any baby chick, duckling or
other | ||||||
10 | fowl which has been dyed, colored, or otherwise treated to | ||||||
11 | impart an
artificial color thereto. Baby chicks or ducklings | ||||||
12 | shall not be sold, offered
for sale, bartered, or given away as | ||||||
13 | pets or novelties. Rabbits, ducklings
or baby chicks shall not | ||||||
14 | be awarded as prizes.

15 | No person may allow for the adoption, transfer, sale, | ||||||
16 | offer for sale, barter, or give away any animal forfeited or | ||||||
17 | relinquished under Section 3.04 or 3.05 of this Act to the | ||||||
18 | person who forfeited the animal or a person residing in that | ||||||
19 | person's household. | ||||||
20 | A person convicted of violating this Section is guilty of | ||||||
21 | a Class B
misdemeanor. A second or subsequent violation is a | ||||||
22 | Class 4 felony, with
every day that a violation continues | ||||||
23 | constituting a separate offense.
