1 | AN ACT concerning criminal law.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Code of Criminal Procedure of 1963 is | |||||||||||||||||||
5 | amended by changing Section 103-2 as follows:

6 | (725 ILCS 5/103-2) (from Ch. 38, par. 103-2)
| |||||||||||||||||||
7 | Sec. 103-2. Treatment while in custody.
| |||||||||||||||||||
8 | (a) On being taken into custody every person shall have the | |||||||||||||||||||
9 | right to
remain silent.

10 | (b) No unlawful means of any kind shall be used to obtain a | |||||||||||||||||||
11 | statement,
admission or confession from any person in custody.

12 | (c) Persons in custody shall be treated humanely and | |||||||||||||||||||
13 | provided with
proper food, shelter and, if required, medical | |||||||||||||||||||
14 | treatment without unreasonable delay if the need for the | |||||||||||||||||||
15 | treatment is apparent .
